Ch. 7, Art. VII, of the 1979 Code.) Amendments noted where applicable.]
The owners or occupants of houses, dwellings and buildings in the City
of Scranton and all persons who erect houses, residences, and other buildings
within the City of Scranton after this chapter becomes effective, are hereby
required to attach an assigned street number displayed in position easily
observed and readable from the public right-of-way or street. All numbers
shall be in arabic numerals (e.g., 1, 2, 3, etc.) at least three inches (76
millimeters) high and 1/2 inches (13 millimeters) stroke. Those owners or
occupants who already have an assigned street numbers are to continue to use
the same unless the City shall direct otherwise. Script numbering and other
forms of numbering shall not be used due to the difficulty of reading.
As used in this chapter, the following terms shall have the meanings
indicated:
A residential building or unit occupied by persons other that its
owner, such as tenants.
A residential building or unit occupied by its owner.
Includes commercial, industrial, nonprofit, or religious structures
within the City of Scranton.
The example of the BOCA Property Maintenance Code, Section 304.3, entitled
"street numbers," is hereby adopted, as an example for compliance, and incorporated
herein by references as though set forth herein at length.
The City Engineer or his designee will designate free of charge upon
written application made to him the appropriate street numbers. The City Engineer
is hereby authorized to prescribe the form of such application.
A.
The City of Scranton shall have one year from the date
of approval by the Mayor of this chapter to be in compliance with this chapter.
B.
All churches, synagogues and mosques shall have six months
to be in compliance from the date of such approval.
C.
All buildings which shall be constructed in the City
on or after the date of such approval of this chapter shall be marked with
their assigned street number within 30 days from the date of completion thereof
and within 10 days of occupancy if a house or other dwelling.
A.
Any person violating this chapter shall, upon conviction (except as provided in § 193-6B), be fined not less than $100 and not more than $300 for each such offense, plus costs of prosecution, and in default of the said payment, be imprisoned until the said fine shall be paid, not exceeding 30 days. Each day that a structure, dwelling or house is not numbered with a visible street number as assigned shall constitute a separate offense.
B.
If the evidence shows that a person(s) died from fire,
disease or other reason due at least in part to an inability to locate an
address because the house or other structure had not displayed its assigned
street number, the fine shall be $300 for each such offense, plus costs of
prosecution, and in default of the payment of said fine, to be imprisoned
until said fine and costs be paid, not exceeding 90 days. Each death shall
constitute a separate offense under this subsection.
C.
This chapter shall not be constructed to limit or prevent
the prosecution of any violation of any BOCA code section relating to street
numbering. The City expressly reserves the right to prosecute under this chapter
or under any applicable BOCA code provision as the City Solicitor or Assistant
City Solicitor shall deem appropriate.
A.
The following officials and City employees are hereby
authorized to enforce this chapter: all police officers, the Superintendent
of Fire and his Deputy, the Fire Prevention Officer and Fire Inspectors of
the Scranton Fire Department, the Master Code Official, or his Assistant,
Building Inspector and Assistant Building Inspectors of the Department of
Community Development, all Health Inspectors of the City of Scranton, the
Zoning Officer, or Assistant Zoning Officer of the City of Scranton. It shall
be the duty of every ambulance company to report a violation of this chapter
to one of the above officials, who shall investigate and initiate prosecution,
if warranted.
B.
It is the intent of the governing body of the City of Scranton (Mayor and Council) that warnings be issued for a period of 30 days after the approval of this chapter or after any time stated for compliance, provided that if there is a violation of § 193-6B, no warnings shall be issued, and violations thereof shall be prosecuted.
