As used in this chapter, the following terms shall have the meanings indicated:
ABANDONED VEHICLE
A. 
A vehicle:
(1) 
That is inoperable and left unattended on a highway or other public property for more than 48 hours; or
(2) 
That has remained illegally on a highway, street or on other public property for a period of more than 48 hours; or
(3) 
Without a valid registration plate or certificate of inspection or title left unattended on or along a public property; or
(4) 
That is left unattended or along a highway or other public property for more than 48 hours and does not bear the following:
(a) 
A valid registration plate.
(b) 
A certificate of inspection.
(c) 
An ascertainable vehicle identification number; or
(5) 
That has remained on private property without the consent of the owner or person in control of the property for more than 48 hours.
B. 
Vehicles and equipment used or to be used in construction or in the operation or maintenance of highways or public utility facilities, which are left in a manner which does not interfere with the normal movement of traffic, shall not be considered to be abandoned.
C. 
Moving a vehicle from one location on the right-of-way to another location on the right-of-way shall not be a defense to a violation of any provision of this chapter, nor shall moving the vehicle to another portion of the right-of-way extend any time periods herein.

JUNK VEHICLE
A vehicle not possessing a current and valid registration and a current official inspection sticker or a vehicle of any age that is damaged or defective in any one or combination of any of the following ways that either makes the vehicle immediately inoperable or would prohibit the vehicle from being operated in a reasonably sale manner upon the public streets and highways under its own power if self-propelled, or while being towed or pushed, if not self-propelled:
A. 
Flat tires, missing tires, missing wheels or missing or partially or totally disassembled tires and wheels.
B. 
Missing or partially or totally disassembled essential part or parts of the vehicle's drive train, including, but not limited to, engine, transmission, transaxle, drive shaft, differential or axle.
C. 
Extensive exterior body damage or missing or partially or totally disassembled essential body parts, including, but not limited to, fenders, doors, engine hood, bumper or bumpers, windshield or windows.
D. 
Musing or partially or totally disassembled essential interior parts, including, but not limited to, driver's seat, steering wheel, instrument panel, clutch, brake or gear shift lever.
E. 
Missing or partially or totally disassembled parts essential to the starting or running of the vehicle under its own power, including, but not limited to, starter, generator or alternator, battery, distributor, gas tank, carburetor or fuel injection system, spark plugs or radiator.
F. 
Interior is a container for metal, glass, paper, rags or other cloth, wood, auto parts, machinery, waste or discarded materials in such quantity, quality and arrangement that a driver cannot be properly seated in the vehicle.
G. 
Lying on the ground (upside down, on its side or at other extreme angle), sitting on block or suspended in the air by any other method.
H. 
General environment in which the vehicle sits, including, but not limited to, vegetation that has grown up around, in or through the vehicle, the collection of pools of water in the vehicle and the accumulation of other garbage or debris around the vehicle.
JUNKYARD
A premises licensed by the City of Scranton as a junkyard.
LESSEE
Owner, for the purpose of this chapter, when the lessor holds the lessee responsible for maintenance and repairs.
MOTOR VEHICLE
Any type of mechanical device, propelled by a motor, in which persons or property may be transported upon public streets or highways and including trailers or semitrailers pulled thereby.
NUISANCE
Any condition, structure or improvement which shall constitute a threat or potential threat to the health, safety or welfare of the citizens of the City of Scranton.
OWNER
The actual owner, agent or custodian of the property on which motor vehicles are stored, whether individual or partnership, association or corporation.
PERSON
Natural person, firm, partnership, association, corporation or other legal entity.
PRIVATE PARKING LOT
A parking lot open to the public or used for parking without charge or a parking lot used for parking with charge.
SALVOR
A person or business authorized by the City of Scranton to tow vehicles.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway or street, except devices used exclusively upon rails or tracks, specifically including but not limited to cars, buses, motorcycles and trucks.
WAREHOUSEMAN
A person engaged in the business of storing goods for hire, as defined by the Uniform Commercial Code (UCC).
