[Adopted 4-11-1990 by Ord. No. 1990-1 (Ch. 5, Part 6, of the 1990 Code)]
There is hereby adopted by the Board of Commissioners of the Township of Swatara for the purpose of establishing rules and regulations governing the maintenance, rehabilitation, demolition, and use and occupancy of existing dwellings, buildings and structures, including the plumbing and electrical wiring systems thereof, and providing for penalties, that certain existing structures code known as the BOCA National Existing Structures code, recommended by the Building Officials and Code Administrators International, Inc., being particularly the Second Edition, 1987, save and except such portions as are hereinafter deleted, modified or amended, of which not less than three copies have been and now are filed in the office of the Secretary of the Township of Swatara and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this article shall take effect, the provisions thereof shall be controlling in the maintenance, rehabilitation, demolition, and use and occupancy of existing dwellings, buildings and structures, including the plumbing and electrical wiring systems, thereof, within the limits of the Township of Swatara.
Nothing in this article or in the existing structures code hereby adopted shall be constructed to affect any suit or proceeding now pending in any court, or any rights acquired, or liability incurred, nor any cause or causes of action accrued or existing, under any act or ordinance repealed hereby; nor shall any right or remedy of any character be lost, impaired, or affected by this article.
Where the provision of this article is found to be in conflict with a provision of any building or zoning ordinance, or in any other ordinance of Swatara Township existing on the effective date of this article, or in any regulation issued under the authority of such ordinances, the provision which established the higher standard for the protection of health, safety and welfare shall prevail.
The following sections of the BOCA National Existing Structures Code, Second Edition, 1987, are hereby revised as follows:
A. 
Section ES-100.0, General, § ES-100.1, Title, is hereby amended to read as follows:
ES-100.8 General: For the purposes of this code, the Code Official shall be the Code Enforcement Officer established in the Code of Ordinances of the Township of Swatara, Chapter 128, Article I. The Code Enforcement Officer shall be responsible for the administration and enforcement of this code as set forth in the Code of Ordinances of the Township of Swatara, Chapter 128, Article I, Administration.
B. 
Sections ES-104.0 through ES-112.0 are hereby deleted in their entirety.
C. 
Section ES-110.0, Violations, § ES-110.2, Penalty, is hereby amended to read as follows:
ES-110.2 Penalty: Any person, firm or corporation, who shall violate any provision of this code shall, upon conviction thereof, be subject to a fine of not less than $30 nor more than $1,000 plus costs of prosecution, or imprisonment for a term not to exceed 30 days, or both, at the discretion of the court. Each day that a violation continues after due notice has been served, in accordance with the terms and provisions hereof, shall be deemed a separate offense.
D. 
Section ES-301.0, Exterior Property Areas, § ES-301.1.1 is hereby deleted in its entirety.
E. 
Section ES-301.0, Exterior Property Areas, §§ ES-301.6, ES-301.7, ES-301.10, ES-301.10.1, and ES-301.10.2 are hereby deleted in their entirety.
F. 
Section ES-303.0, Interior Structure, § ES-303.2, Structural Members, is hereby amended to read as follows:
ES-303.2 Structural Members: The supporting structural members of every building shall be maintained structurally sound, not showing any evidence of deterioration which would render them incapable of carrying the imposed loads. The owner or occupant shall, if requested by the Code Official, cause the weight that each floor will safely sustain to be calculated by a registered architect or engineer, and after acceptance by the Code Official, to be posted on each floor in a conspicuous place.
G. 
Section ES-404.0, Space Requirements, § ES-404.1.1, Water Closet Accessibility, is hereby amended to read as follows:
ES-404.1.1 Water Closet Accessibility: Every room used as a bedroom shall have access to at least one water closet without passing through another room used as a bedroom.
H. 
Section ES-404.0, Space Requirements, § ES-404.6, is hereby deleted in its entirety.
I. 
Section ES-601.0, Heating Facilities, § ES-601.2, Other Structures, is hereby amended by adding the following to the list of exceptions:
3. Storage areas and warehouses.
J. 
Section ES-602.0, Electrical Facilities, § ES-602.1, Facilities Required, is hereby amended to read as follows:
ES-602.1 Facilities Required: Every building or part thereof used for human occupancy shall be adequately and safely provided with an electrical system in compliance with the requirements of this section. The provisions of §§ ES-602.1.1 to ES-602.1.2 shall be considered absolute minimum requirements.
K. 
Section ES-602.0, Electrical Facilities, § ES-602.1.1, Receptacles, is hereby amended to read as follows:
ES-602.1.1 Receptacles: Every habitable space in a dwelling unit, and every guest room shall contain at least two separate and remote receptacle outlets or one such receptacle outlet and one ceiling or wall type electric light fixture or such other fixtures or devices as will provide equivalent electric service. Every bathroom shall contain at least one receptacle.
L. 
Section ES-602.0, Electrical Facilities, § ES-602.1.3, Service, is hereby deleted in its entirety.
M. 
Section ES-602.0, Electrical Facilities, § ES-602.2, Installation, is hereby amended to read as follows:
ES-602.2 Installation: All electrical equipment, wiring and appliances shall be properly installed, maintained in good and safe working condition and connected to the source of electrical energy in a safe manner in accordance with the requirements of the Township Electrical Code.
N. 
Section ES-704.0, Fire Protection Systems, § ES-704.5, Fire Extinguishers, is hereby amended to read as follows:
ES-704.5 Fire Extinguishers: All portable fire extinguishing equipment shall be of an approved size and type suitable to the occupational use of the building and shall be installed in corridors or other locations. In hotels, dormitories and apartment houses, at least one fire extinguisher shall be provided on each floor at the stairway landing and in the corridor at each elevator or bank of elevators. Additional fire extinguishers shall be installed in corridors so that the maximum distance between any two fire extinguishers shall not exceed 75 feet. All portable fire extinguishing equipment required in this section shall be properly mounted, visible and readily accessible to the occupants of the building, and maintained in safe operating condition.
