The office of Borough Manager is hereby created by the Borough of Wilson.
The Manager shall be appointed for an indefinite term by a majority of all members of the Council. The Manager shall serve at the pleasure of the Council, and he/she may be removed at any time by a majority vote of all its members. At least 30 days before such removal becomes effective, the Council shall furnish the Manager with a written statement setting forth its intention to remove him/her and the reasons therefor.
The Manager shall be chosen solely on the basis of his/her executive and administrative abilities, degree and training, with special reference to the years of experience in or knowledge of accepted practices in respect to the duties of his/her office as herein outlined. The Manager need not be a resident of the Borough of Wilson but must reside within a five-mile radius of the Borough boundaries within a prescribed period of time established by the Council, not to exceed one year.
Before entering upon his/her duties, the Borough Manager shall give a bond to the Borough, with a bonding company as surety, in the sum of $10,000, conditioned for the faithful performance of his/her duties, the premium for said bond to be paid for by the Borough of Wilson. The bond of the Borough Manager may be included in and the Manager may be bonded under and covered by the blanket bond in force and effect for other Borough employees.
The salary of the Borough Manager shall be fixed from time to time by the Borough Council in the same manner as compensation for all other Borough employees.
The Manager shall be the chief administrative officer of the Borough, and he/she shall be responsible to the Council as a whole for the proper and efficient administration of the affairs of the Borough. His/her powers and duties shall relate to the general management of all Borough business not imposed or conferred upon other Borough officers expressly by statute. Subject to recall by ordinance of the Council, the powers and duties of the Borough Manager shall include the following:
A. 
He/she shall supervise and be responsible for the activities of all municipal departments, except such departments where said supervision is not delegated by the Council or by the Mayor, as the case may be.
B. 
With concurrence of the Council, he/she shall hire and, when necessary for the good of the service, shall suspend or discharge all employees under his/her supervision, provided that persons covered by the civil service provisions of the Borough Code shall be hired, suspended or discharged in accordance with such provisions, provided further that the Manager shall immediately report in writing to all members of the Council and furthermore present in person at the next meeting thereafter of the Council any action taken by authority of this subsection.
C. 
He/she shall make recommendations to the Council with respect to the compensation of all employees under his/her supervision, but such compensation shall be fixed by the Council.
D. 
He/she shall prepare and submit to the Council, before the close of the fiscal year or on such alternate date as the Council shall determine, a budget for the next fiscal year as an explanatory budget message. In preparing the budget, the Manager shall obtain from the head of each department, agency, board or officer estimates of revenues and expenditures and other supporting data as he/she requires. The Manager shall review such estimates and may revise them before submitting the budget to the Council.
E. 
He/she shall be responsible for the administration of the budget after its adoption by the Council.
F. 
He/she shall attend all meetings of the Council and, when requested, its committees, with the right to take part in the discussion.
G. 
He/she shall keep the Council informed as to the conduct of Borough affairs, submit quarterly reports of the condition of Borough finances and such other reports as the Council requests and make such recommendations to the Council as he/she deems necessary.
H. 
He/she shall submit to the Council, as soon as possible, after the close of the fiscal year, a complete report on the financial and administrative activities of the Borough for the preceding year.
I. 
He/she shall employ, by and with approval of Council, experts and consultants to perform work and to advise in connection with any of the functions of the Borough.
J. 
He/she shall see that the provisions of all franchises, leases, permits and privileges, such as zoning, housing, building, plumbing and electrical, granted by the Borough are observed.
K. 
He/she shall attend to the letting of contracts in due form of law, and he/she shall supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed upon some other Borough official by statute or by direction of the Council.
L. 
He/she shall see that all money owed the Borough is promptly paid and that proper proceedings are taken for the security and collection of all of the Borough's claims.
M. 
He/she shall be the purchasing officer of the Borough, and he/she shall purchase, in accordance with the provisions of the Borough Code, all supplies and equipment for the various agencies, boards, departments and other offices of the Borough. He/she shall keep an account of all purchases and shall, from time to time or when directed by Council, make a full written report thereof. Subject to the approval and within the monetary bounds set forth by the Council, he/she shall, upon his/her signature, approve the requisition and purchase of all municipal supplies and equipment.
N. 
All complaints regarding services or personnel of the Borough shall be referred to the office of the Manager. He/she or an officer designated by him/her shall investigate and dispose of all such complaints, and the Manager shall report thereon to the Council.
The Mayor is hereby authorized to delegate to the Borough Manager, subject to recall by written notification at any time, any of his nonlegislative and nonjudicial powers and duties.
If the Manager becomes ill or needs to be absent from the Borough, he/she shall yield his/her duties to the Borough Secretary during his/her absence or disability.
