There is hereby established a separate sewer district in Worcester Township which shall be comprised of the commercial, office and other authorized uses in the Center Point Village Shopping Center and shall be known as the "Center Point Village Sewer District."

A. 
The following minimum charges for each 1,000 gallons of metered water consumed per month at the Center Point Village Shopping Center are hereby imposed upon the owner of the Center Point Village Shopping Center and upon its successors in title, payable as herein provided, which shall be collected by Worcester Township and used for payment of the cost of operating and maintaining that portion of the Township's sewage collection and disposal system comprising the Center Point Village Sewer District and for a reserve fund sufficient for its future replacement: effective January 1, 2014, a charge of $6.82; effective January 1, 2015, a charge of $7.50; and effective January 1, 2016, a charge of $8.25. This minimum charge is based upon Center Point Village discharging sewage with the characteristics of typical domestic sewage with a strength no greater than the following concentrations:

Strength of sewage will be determined by taking a monthly twenty-four-hour composite sample of wastewater as it enters the Center Point Village pumping station prior to pumping to the wastewater treatment plant. The composite sample will be tested for the four parameters referenced above, and any parameter found to be in excess of the maximum allowable concentration will be used to calculate a sewage surcharge fee to be added to the minimum charge, based upon the following formula:

When a parameter is less than the maximum allowable concentration, that portion of the formula shall be assumed to be zero.
The total sewage charge shall, therefore, be the sum of the minimum charge, based upon total flow, plus any applicable surcharge.
For the purpose of computing the charges imposed by § 122-20, the gallonage of sewage shall be determined by metered flow discharged from the Center Point Sewer District. The owner of the Center Point Village Shopping Center shall from time to time, upon demand, provide access to the meter facility to such person as the Township shall designate to allow meter readings to be taken.
Bills for the sewage charges imposed hereby shall be rendered monthly on the first day of each month, or on such other dates as the Township shall specify, and shall cover the billing period consisting of the immediately preceding month. Bills shall be due and payable on the billing date, and the appropriate amount computed in accordance with this article shall constitute the net bill. If the charges are not paid within 30 calendar days after each billing date, an additional sum of 10% shall be added to such net bill, which net bill, plus such additional sum, shall constitute the gross bill. Payment made or mailed and postmarked on or before the first day of the end of such thirty-calendar-day period shall constitute payment within such period. If the end of such thirty-calendar-day period shall fall on a legal holiday or on a Saturday or Sunday, payment made or mailed and postmarked on the next succeeding day which is not a legal holiday shall constitute payment within such period. Any bill not paid within said thirty-calendar-day period shall be deemed delinquent.
The sewage charges imposed by this article shall be a lien upon all real property within the Center Point Village Sewer District; and any such charges which are delinquent shall be filed as a lien against said property, which lien shall be filed in the office of the Prothonotary of Montgomery County, Pennsylvania, and shall be collected in the manner provided by law for the filing and collecting of municipal claims. Interest collectible on liens filed by the Township shall accrue at the rate of 10% per annum from the date of the filing of the lien until paid.

In the event an account is delinquent as set forth in § 122-22 of this chapter, the Township, at its option, may make request to Superior Water Company to shut off the supply of water to the delinquent premises until Township is in receipt of all such overdue rentals, rates and charges, together with any interest thereon. The charges shall include a thirty-five-dollar fee for the cost of shutting off water services and a thirty-five-dollar fee for the cost of restoration of water services. In the event the actual cost of shutting off or restoring water service exceeds $35, the charge shall be the actual cost of shutting off or restoring water service. The charges shall also include the cost of lost water revenues, as determined by Superior Water Company, based upon the actual period of time during which the supply of water is shut off in each instance and the average water revenue received by Superior Water Company for a like period of time during the year prior to such shutoff from the class of customer involved in each instance. The Township shall be under no obligation to request restoration of water service to the premises until all such overdue rentals, rates and charges are satisfied. In the event such overdue rentals, rates and charges, together with any interest thereon, have not been satisfied, the same shall constitute a lien against the premises.
