The following sections of the Pennsylvania Uniform Construction Code are hereby amended and changed as follows:
A. 
Section 401.2a, Municipal and third-party Agency fees, Subsection (a), is amended by addition of a new Subsection (1) as follows:
(1) 
Permit fees shall be in accordance with a schedule adopted by resolution of the Board of Commissioners from time to time.
B. 
Section 403.2, Other statutes or ordinances, Subsection (a), is amended by addition of the following subsections:
(1) 
All building code ordinances or portions of ordinances, including but not limited to those identified in Subsection 403.2(a)(2), which were adopted by the Township of Springfield on or before July 1, 1999, and which equal or exceed the requirements of the Pennsylvania Uniform Construction Code, shall continue in full force and effect until such time as such provisions fail to equal or exceed the minimum requirements of the Pennsylvania Uniform Construction Code, as amended from time to time.
(2) 
Amendments to the Pennsylvania Uniform Construction Code:
(i)
Application for permits. Evidence of approval by the Pennsylvania Department of Labor and Industry, when required, shall accompany all applications. (Amended Section 111.0 of the 1981 BOCA Building Code; adopted 3-10-1982 by Ord. No. 711)
(ii)
Curbs and sidewalks: Concrete curbs and/or sidewalks shall be constructed in accordance with the specifications of the Township Engineer when a lot or lots are being developed in an area where a curb and/or sidewalk exists on at least one side of adjacent and contiguous lots. It shall be the intent of this section to require the continuity of street improvements in an area where adjacent and contiguous property has been so improved. (iii)
Use Group R, Residential Buildings, minimum habitable floor area: Except in the case of multifamily apartment development having one-bedroom apartment dwellings totaling 70% or more of the total number of apartment dwelling units in such development, each dwelling unit shall have a minimum habitable floor area of 800 square feet per dwelling. Where a multifamily apartment development has 70% or more one-bedroom dwelling units, the number of habitable floor areas of one-bedroom dwelling units shall be as follows and no studio or efficiency dwelling unit shall be permitted: Not more than 30% of the total number of dwelling units shall be one-bedroom dwelling units having a minimum of 600 and a maximum of 650 square feet of habitable floor area; not less than 30% of the total number of dwelling units shall be one-bedroom dwelling units having a minimum of more than 650 and a maximum of 725 square feet of habitable floor area; not less than 10% of total dwelling units shall be one-bedroom dwelling units having a minimum of more than 725 square feet of habitable floor area.
"Habitable floor area" shall be defined to mean the floor area of a dwelling unit within the outside walls thereof, exclusive of attics, basements, garages, open porches and accessory buildings. (Amended Section 308.0 of the 1981 BOCA Building Code; adopted 7-12-1989 by Ord. No. 772)
(iv)
Fire Limits: The limits of fire areas are described as bounded by Zoning Districts Business 1, Business 2, Shopping Center and Industrial. (Amended Section 501.2 of the 1981 BOCA Building Code; adopted 3-10-1982 by Ord. No. 711)

(vi)
High-hazard dry cleaning plants: Not permitted. (Amended Section 612.3.1 of the 1981 BOCA Building Code; adopted 3-10-1982 by Ord. No. 711)
(vii)
Drainage of yard areas and roofs: All roofs, paved areas, yards, courts and courtyards shall be drained into the stormwater system where accessible, but not into the sanitary sewer system. Where there is no stormwater sewer accessible, such connections shall be discharged into the public gutter, but not over the surface of any sidewalks; provided, however, that when discharge into the public gutter is impractical by reason of distance or natural slope, the Building Inspector may permit such connection over the surface of the premises if adequate provision is made to prevent seepage into any cesspool, septic tank or disposal field or into any cellar and to prevent damage to any neighboring property. (viii)
Flood damage controls: The following is hereby added as follows:
Scope: In order to prevent excessive damage to buildings and structures due to conditions of flooding, the regulations and construction standards outlined in Article XIIA of the Springfield Township Zoning Ordinance of 1940, as amended, shall apply to all new construction occurring within the Township's designated Floodplain Conservation District. (Amended the 1981 BOCA Building Code by adding Article 26; adopted 2-12-1997 by Ord. No. 822)
(ix)
Fire-suppression systems shall be required as follows:
All use groups: An automatic fire suppression system shall be installed in any structure or portion thereof that is constructed using fabricated wood components such as but not limited to pre-engineered wood floor or roof truss systems, prefabricated wood I-beams or joists or glued-laminated lumber.
Exception: Additions or alterations to dwellings of Use Group R-4, provided the existing building does not currently maintain an approved fire-suppression system.
All Use Groups: In a mixed-use occupancy, an automatic fire-suppression system shall be installed in any portion of a structure below a residential use, regardless of floor area.
Storage and workshop areas: In all portions of Use Groups A, B and I occupied for storage, workshop or similar purposes.
Exception: Storage and workshop rooms less than 50 square feet in area.
Use Group R-4 structures: In all buildings or structures or portions thereof, of Use Group R-4 when one or more of the following apply:
(a)
Structure is located more than 600 linear feet from the nearest fire hydrant measured along a street, paved road or driveway.
(b)
The entire structure contains more than 4,000 square feet of gross floor area.

(x)
Water-flow-detecting devices: All required water flow detecting devices shall be installed in accordance with the latest edition of NFPA 13. (Amended Article 17 of the BOCA Building Code; adopted 3/10/1982 by Ord. No. 711)
(xi)
Sprinkler alarms: Alarms and alarm attachments shall be required in limited area sprinkler systems in accordance with Sections 1704.5, 1704.5.1 and 1704.5.2 of the 1981 BOCA Building Code. (Amended Article 17 of the 1981 BOCA Building Code; adopted 3-10-1982 by Ord. No. 711)
(3) 
Section 403-42(a) shall be amended by adding a new Subsection (1) to read as follows:
"The applicant shall submit two sets of documents when the Department conducts the review."
(4) 
Section 403-42(b) shall be amended to read as follows:
"Emergency repairs or replacement of equipment may be made without first applying for a permit if a permit application is submitted to the building code official within one business day of the repair or replacement."
(5) 
Section 403-42(c)1 shall have the following items amended or deleted from the list of permit exempt items as indicated:
(iii)
DELETE: Retaining walls, which are not over four feet in height measured from the lowest level of grade to the top of the wall, unless it is supporting a surcharge or impounding Class I, II or III-A liquids.
(iv)
DELETE: Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons and the ratio of height to diameter or width does not exceed 2 to 1.
(v)
DELETE: Sidewalks and driveways not more than 30 inches above grade and that are not located over a basement or story below it and which are not part of an accessible route.
(vii)
DELETE: Temporary motion picture, television, and theater stage sets and scenery.
(x)
DELETE: Window awnings supported by an exterior wall which do not project more than 54 inches from the exterior wall and do not require additional support of Group R-3 as applicable in the "International Building Code," and Group U occupancies.
(xii)
DELETE: Window replacement without structural change.
(6) 
Section 403-62(c)1 shall have the following items amended or deleted from the list of permit exempt items as indicated:
(ii)
DELETE: Retaining walls, which are not over four feet in height measured from the lowest level of grade to the top of the wall, unless it is supporting a surcharge or impounding Class I, II or III-A liquids.
(iii)
DELETE: Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons and the ratio of height to diameter or width does not exceed 2 to 1.
(iv)
DELETE: Sidewalks and driveways not more than 30 inches above grade and that are not located over a basement or story below it and which are not part of an accessible route.
(viii)
DELETE: Window awnings supported by an exterior wall which do not project more than 54 inches from the exterior wall and do not require additional support.
(x)
DELETE: Installation and replacement of a window, door, garage door, storm window and storm door in the same opening if the dimensions or framing of the original open opening are not altered. The installation of means of egress and emergency escape windows may be made in the same opening without altering the dimensions or framing of the original opening if the required height, width or net clear opening of the previous window or door assembly is not reduced.
(xi)
DELETE: Replacement of existing roof material that does not exceed 25% of the total roof area performed within any twelve-month period.
(xiii)
DELETE: Replacement of existing siding.
(xvii)
DELETE: Installation of an uncovered deck where the floor of the deck is no more than 30 inches above grade.
(viii)
DELETE: Replacement of traps.
(ix)
DELETE: Replacement of a water closet, lavatory or kitchen sink.
(x)
DELETE: Replacement of domestic dishwashers.
C. 
Section 403.1, Scope, is amended as follows:

Exclusions. The Uniform Construction Code does not apply to:

The following structures if the structure has a building area less than 1,000 square feet and is accessory to a detached one-family dwelling:
(i)
DELETED: Exempted carports.
(ii)
DELETED: Exempted detached private garages.
(iii)
DELETED: Exempted greenhouses.
(iv)
DELETED: Exempted sheds.
