The Supervisor of the Town of Tonawanda, by
and through the Executive Director of the Town of Tonawanda Development
Corporation, is hereby authorized and directed to prepare and submit
an application to the Chairman and Commissioner of the Empire State
Development Corporation for designation of an area within the jurisdiction
of the Town of Tonawanda as a New York State Empire Zone.
The Town Assessor of the Town of Tonawanda is
hereby designated as the official who shall serve as the "Local Zone
Certifier." Said Certifier shall have such powers and duties as authorized
by New York State General Municipal Law, Article 18-B.

GFD LLC is a recently formed New York limited-liability
company that has proposed purchasing five contiguous parcels on Milens
Avenue in the Town of Tonawanda.

The GFD Project ("project") is defined as an investment
of $14.5 million ($6.5 million in land and building acquisition, $2
million in building upgrades and expansion and $6 million in equipment),
and the creation of approximately 93 jobs over a two-year period to
manufacture products for the automotive industry.

The Empire Zone Administrative Board of the Town of
Tonawanda has determined that the project is eligible for Empire Zone
benefits as a regionally significant project under § 957(d)(i)
of the General Municipal Law.

Vanocur Refractories is a start-up company that has
proposed leasing space in a building located at 3937 River Road in
the Town of Tonawanda.

The Vanocur Refractories Project ("Project") is defined
as an investment of $225,000 in building improvements, $500,000 in
equipment, and the creation of 50 jobs over a five-year period to
commercialize new technology that will lower the cost of repairing
coke oven batteries.

The building owner, Braxner LLC, has invested approximately
$1,000,000 to purchase and renovate the 219,000 square foot building
that had been abandoned after its former owner, Sivaco, declared bankruptcy
three years ago.

Representatives of Vanocur Refractories have stated
that access to Empire Zone benefits is a critical factor in the company's
decision to implement the Project in the Town of Tonawanda rather
than a facility in Erie, Pennsylvania.

as an investment of $2.4 million in equipment and the creation of
325 jobs over a three-year period to market and service insurance
products.

Representatives of GEICO Insurance Agency, Inc., have stated that
access to Empire Zone benefits is a critical factor in the company's
decision to implement the project in the Town of Amherst rather than
a facility in Fredericksburg, Maryland.
(4)Â
The New York State Department of Economic Development has determined
that the project is eligible as a regionally significant project under
§ 957(d)(i) of the General Municipal Law.

The Empire Zone Administrative Board of the Town of Tonawanda has
determined that the project is eligible as a regionally significant
project under § 957(d)(i) of the General Municipal Law.

than corporate facilities in California, Maryland, New Zealand or
Scotland.

to manufacture biodiesel fuel.

to Empire Zone benefits is a critical factor in the company's
decision to implement the project in the Town of Tonawanda rather
than sites in Connecticut, Massachusetts, or Rhode Island.

The New York State Department of Economic Development has determined
that the project is eligible as a regionally significant project under
Section 957(d)(i) of the General Municipal Law.

The Empire Zone Administrative Board of the Town of Tonawanda has
determined that the project is eligible as a regionally significant
project under Section 957(d)(i) of the General Municipal Law.

It is, therefore, the desire of this Town Board to approve the allocation
