This chapter shall be known as the "Games of Chance Law of the City of Canandaigua." This chapter is enacted pursuant to Article 9-A of the General Municipal Law for the purposes set forth therein.
As used in this chapter, the following terms have the following meanings:
AUTHORIZED ORGANIZATION
Includes such organizations as are set forth in Subdivision 4 of § 186 of the General Municipal Law.
CITY
The City of Canandaigua, New York.
GAMES OF CHANCE
A game of chance as defined in Subdivision 3 of § 186 of the General Municipal Law.
Authorized organizations may, upon obtaining a license from the Clerk/Treasurer of the City of Canandaigua, conduct games of chance within the City of Canandaigua in accordance with Article 9-A of the General Municipal Law and as provided further in this chapter. The regulation and conduct of games of chance shall be in accordance with state law, rules and regulations of the New York State Racing and Wagering Board and this chapter.
The conduct of games of chance authorized by this chapter and by Article 9-A of the General Municipal Law shall be subject to the mandatory restrictions of that law and any other additional restrictions as may be imposed from time to time by the City of Canandaigua.
Games of chance on the first day of the week, commonly known as "Sunday," may be conducted in the City of Canandaigua pursuant to this chapter and appropriate statutes and regulations.
The chief law enforcement officer of the City, the Chief of Police, shall exercise control over and supervision of all games of chance conducted under an appropriately issued license. The Chief of Police shall exercise all those powers as set forth in Article 9-A of the General Municipal Law.
This chapter shall take effect upon approval by a vote of the majority of the qualified electors of the City of Canandaigua voting thereon of a proposition submitted at a special election to be held pursuant to the provisions of the Municipal Home Rule Law.[1]
