[HISTORY: Adopted by the Town Board of the Town of Haverstraw 5-8-1950 by ordinance (Ch. 4 of the 1966 Code). Sections 56-4H and 56-5A amended at time of adoption of Code; see Ch. 1, General Provisions, Art. I. Other amendments noted where applicable.]
It shall be unlawful for any person, partnership, association or corporation to conduct within the limits of the Town of Haverstraw any public auction without a permit first had and obtained as hereinafter provided.
Each applicant for such permit shall submit to the Town Clerk his application for such permit, together with a description stating the location and character of the building wherein he expects to conduct such auction and a written statement showing that he is a citizen of the United States and that he has never been convicted of a felony or misdemeanor. No permit shall be granted to any person who is not a citizen of the United States or who has been convicted of a felony or who, in the opinion of the Town Board, is not a proper and fit person capable of properly conducting the business for which the permit is required. If the applicant possesses all the required qualifications, the Town Clerk shall, upon payment by the applicant of the permit fee hereinafter prescribed, issue a permit to such applicant.
The fee for such a permit is hereby fixed at the sum of $50. Such permit shall be effective from the date of issuance until such auction sale for which said permit is issued is concluded, unless sooner revoked, and shall not be transferable.
Each such permit shall be issued subject to compliance with all rules, regulations or orders now existing or which may hereafter be made by the Town Board of the Town of Haverstraw respecting such business or the conduct thereof and subject also to compliance with the following additional requirements:
A. 
All auctioneers shall display their merchandise for three days in advance of their posted notice of intent to conduct such an auction sale.
B. 
All goods shall be numbered and referred to by number and description during their presentation for sale.
C. 
Any person holding an auctioneer permit is prohibited from peddling, canvassing or soliciting.
D. 
Any person holding a peddler's license is prohibited from conducting public auctions.
E. 
The following sanitary facilities shall be provided for the public safety and comfort: a public men's and women's toilet, drinking water, a public telephone and an emergency sickroom.
F. 
Shelter shall be provided at all out-of-door public auction sales.
G. 
Any person obtaining a permit to conduct an auction shall post a cash bond of $100 or any other amount so fixed by the Town Board, guaranteeing delivery of all goods sold.
H. 
All buildings used for public auction sales must meet all requirements of the New York State Uniform Fire Prevention and Building Code.[1]

A violation of this chapter may be punishable by a fine of not more than $250 or by imprisonment for not more than 15 days, or both.[1]

B. 
Any violation of this chapter or any of its provisions may be restrained by injunction.
Free permits shall be granted to those whose purpose it is to liquidate local estates, bankrupt businesses, certified antiques and objects of art and sales of delinquent-installment and chattel-mortgage goods and property.
This chapter shall be effective and operative only in that portion of the Town of Haverstraw outside of any incorporated villages therein.
