By authority of the resolution by the Board
of Trustees of the Village of Irvington on the 19th day of November
1928, pursuant to the provisions of Article 6-A of the Village Law
(Chapter 64 of the Consolidated Laws of New York), and pursuant to Article 7 of the Village Law, which became
effective September 1, 1973, as amended, and the Municipal Home Rule
Law, the Planning Board has the power and authority to approve plats
for subdivisions pursuant to the provisions of this chapter.

It is declared to be the policy of the Village
Planning Board to consider land subdivision plats as part of a plan
for the orderly, efficient and economical development of the Village.
This means, among other things, that land to be subdivided shall be
of such character that it can be used safely for building purposes
without danger to health or peril from fire, flood or other menace;
that proper provision shall be made for drainage, water, sewerage
and other needed improvements; that proper provision be made for protecting
the environment, the watershed, scenic views and natural resources
of the Village in order to further the health, safety and welfare
of its inhabitants; that the proposed streets shall compose a convenient
system conforming to the Official Map and shall be properly related
to the proposals shown on such portions of the Village's Comprehensive
Land Use Plan, as may be in existence at any time, and shall be of
such width, grade and location as to accommodate the prospective traffic,
to afford adequate light and air, to facilitate fire protection and
to provide access to fire-fighting equipment to buildings; and that
open spaces for parks and recreational use shall be reserved or dedicated
for public use.

Should any of the provisions of these Land Subdivision
Regulations conflict with any provision of the Village Law, the relevant
provisions of the Village Law shall apply, except to the extent that
conflicting provisions of these regulations were enacted by virtue
of local law pursuant to the Municipal Home Rule Law, in which case
the provisions of these regulations shall apply, notwithstanding any
conflict with the provisions of the Village Law.
In order that land subdivisions may be made
in accordance with this policy, these regulations, which shall be
known and may be cited as the "Village of Irvington Land Subdivision
Regulations," are hereby adopted.
