A.
Active duty for special law enforcement officers. Special law enforcement
officers shall only render police services to the Borough when expressly
assigned to active duty for that purpose by the Chief of Police.
B.
Control of special law enforcement officers. At all times, the special
law enforcement officers will be under the direct control of the Chief
of Police. When on duty, special law enforcement officer shall be
under the supervision of the highest ranking line officer of the Police
Department, unless otherwise specified in the special directives.
No person shall be appointed as a member of the special law
enforcement officer force of the Borough of Westville or for a position
designated herein as support personnel of the Borough of Westville
Police Department unless he is able to satisfy all of those requirements
set forth in § 56-98 herein.
All special law enforcement officers to be appointed by the
Borough of Westville must be citizens of the United States and comply
with the statutory criteria set forth in N.J.S.A. 40A:14-146.
Special law enforcement officers shall be appointed by the Mayor
and Council for a term not to exceed one year. Upon expiration of
the term of a special law enforcement officer and/or termination of
his employment as above described, the powers and duties of such officer
shall be deemed terminated.
The employment of special law enforcement officers and/or support
personnel may be terminated at any time by the Mayor and Council with
or without cause as allowed by the applicable state law.
Special law enforcement officers shall have all the duties and
responsibilities of police officers as allowed under the laws of the
State of New Jersey.
A.
At all times, the special law enforcement officers shall be under
the direct command of the highest ranking line officer then on duty.
B.
The following regulations specifically apply to the special law enforcement
officer:
(1)
No special law enforcement officer officer shall carry a side arm
of any nature or description until said person has been fully certified
as a Class II Special Law Enforcement Officer and has met all firearm
qualification requirements.
(2)
No special law enforcement officer shall carry a side arm, gun or
revolver, or other similar weapon when off duty.
(3)
No special law enforcement officer shall use his private vehicle
on official police business unless directly ordered to do so by the
Chief of Police.
(4)
No special law enforcement officer shall wear the police uniform
except while actually on duty, nor shall he carry any police equipment
in any private vehicle unless reporting to or returning from duty.
(5)
No special law enforcement officer, by virtue of his appointment
as such, shall be a member of the Police Department.
(6)
Every special law enforcement officer, while on duty, shall abide
by all the rules and regulations of the Police Department. Any violation
of the rules and regulations may result in immediate dismissal.
Special law enforcement officers shall be under the supervision
and direction of the Chief of Police and shall perform their duties
pursuant to applicable laws of the State of New Jersey. Special law
enforcement officers shall comply with all the rules and regulations
applicable to the conduct and decorum of the regular police officers
of the Borough of Westville. Prior to appointment of a special law
enforcement officer, the Chief of Police shall ascertain the eligibility
qualifications of the applicant and make a report thereon to the Mayor
and Council of the Borough of Westville.
