GENERAL REFERENCES

The office of Township Manager (hereinafter "Manager" is hereby created for East Brandywine Township (hereinafter "Township").
The Manager shall be appointed for an indefinite term by a majority of all members of the Board, and shall serve at the pleasure of the Board. The Manager shall be subject to removal by the Board by a majority vote. At least 60 days before such removal is to become effective, the Board shall furnish the Manager in writing with a written statement setting forth its intention to remove the Manager.
The Manager shall be chosen solely on the basis of the person's executive, administrative and financial abilities and personal qualities, with special reference to training and experience in municipal government. More particularly, the Manager shall have:
A. 
Extensive knowledge of the theories, concepts and practices of public administration;
B. 
Extensive knowledge of policies and proceedings as they apply to municipal finance and administration;
C. 
Extensive knowledge of managerial practices, and supervisory methods and techniques;
D. 
The ability to communicate effectively in both oral and written form;
E. 
The ability to develop and maintain close working relationships with associates and the general public;
F. 
The ability to control and direct the activities of a multi-departmental organization; and
G. 
The ability to recognize, analyze and investigate problems in a logical manner, and develop alternate solutions.
The Manager need not be a resident of East Brandywine Township.
A. 
The Manager shall be the Chief Administrative Officer of the Township, and shall be responsible to the Board, as a whole, for the proper, efficient and economical administrations of the affairs of the Township. The Manager shall not create public policy, but shall see to the faithful and objective implementation of Board policy and decisions. The Manager shall conduct himself or herself at all times with complete fidelity, and in a way that will reflect credit upon, and benefit to, the Township of East Brandywine, its citizens and its government as a whole. The powers and duties of the administration of all Township business shall be vested with the Manager. All duties hereby delegated shall be subject to recall at any time by ordinance of the Board. This delegation shall not include any legislative powers and duties or those expressly imposed or conferred by statute upon other Township officers.
B. 
Subject to recall by the Board, the powers and duties of the Township Manager shall be as follows:
(1) 
The Manager shall, in accordance with Board policy, direct, supervise and be responsible for the activities of all municipal departments. This is not to infer complete control over the day-to-day operations of municipal departments.
(2) 
The Manager shall, subject to concurrence of the Board and all applicable statues, rules and regulations or collective bargaining agreements, hire and, when deemed necessary, suspend or discharge any employee under his supervision; provided, however, such hiring or discharge of department heads or appointees shall require approval of the Board.
(3) 
The Manager shall normally attend all meetings of the Board and of Township commissions and committees, and participate in such meetings as may be required in the furtherance of his/her duties. The Manager shall receive notice of all special meetings of the Board, its commissions and committees.
(4) 
The Manager shall hold such other Township offices and head such departments as the Board may from time to time direct and are not deemed incompatible by law.
(5) 
The Manager shall prepare, in conjunction with the Township Secretary, prepare the agenda for each meeting of the Board, and supply facts pertinent thereto.
(6) 
The Manager shall keep the Board informed as to the conduct of Township affairs, submit in conjunction with the Township Treasurer periodic reports on the condition of the Township finances, and such other reports as the Board requests, and make recommendations to the Board as he/she deems advisable.
(7) 
The Manager shall see, in conjunction with the Township Treasurer, that all money owed the Township is promptly paid, and that proper proceedings are taken for the security and collection of all Township claims.
(8) 
The Manager shall submit to the Board, as soon as possible after the close of the fiscal year, a complete report on the administrative activities of the Township for the preceding year.
(9) 
The Manager shall prepare and submit to the Board, not less than 45 days prior to the close of each fiscal year, a proposed budget for the next fiscal year. In preparing the budget, the Manager, or any person designated by the Manager, shall obtain from the head of each department, agency, board or commission, or any qualified member thereof, estimates of revenues and expenditures for the next fiscal year, and other such data as the Manager shall require. The Manager shall review such estimates and give them due consideration before submitting the proposed budget for the next fiscal year; provided, however, the Manager shall not be bound by any such estimates. The Manager shall also submit an explanatory budget message along with the proposed and final budgets for the next fiscal year.
(10) 
The Manager shall be responsible for the administration of the budget after its adoption by the Board.
(11) 
The Manager shall initiate such action as may be required with respect to the enforcement of all ordinances, franchises, leases, permits and contracts by the Township.
(12) 
The Manager shall attend to the letting of contracts in the due form of law, supervise the performance and faithful execution of the same, except such duties that are expressly imposed upon some other Township officer.
(13) 
The Manager may employ, subject to the approval of the Board, experts and consultants to perform work, and to advise in connection with any of the functions of the Township.
(14) 
The Manager shall be the purchasing officer for the Township, and shall purchase, in accordance with the Second Class Township Code and concurrence of the Board, supplies and equipment for the departments under his/her supervision, and for other departments, offices, agencies boards and commissions as the Board may direct from time to time.
(15) 
The Manager shall maintain control of all Township expenditures.
(16) 
The Manager, or such other person as designated by him/her, shall investigate and dispense with all complaints pertaining to service or personnel of the Township.
(17) 
The Manager shall analyze, with the assistance of other persons as may be required, all actions requiring Board action, and shall fairly and objectively present to the Board all facts and other information pertinent to such action.
(18) 
The Manager shall use his/her best efforts to maintain a high level of public relations for all elements of Township government, and shall prepare periodic reports of Township activity and such other information as may be directed from time to time by the Board.
(19) 
The Manager shall assume such other responsibilities and perform such other duties as the Board may from time to time direct, and in conformity with all applicable statutes, ordinances and regulations.
The salary of the Manager shall be fixed by resolution duly adopted by the Board at the time of his/her employment, and may be adjusted from time to time in the same manner.
The Manager shall give a bond in the amount fixed by the Board by ordinance to the Township of East Brandywine as surety. This bond shall be conditioned upon the honest and faithful performance of his/her duties. The bond shall be obtained from a reputable firm, the premium for such surety shall be paid by the Township. The initial bond shall be in the amount of $250,000.
Should the Manager be unavailable or unable to perform the duties delegated hereunder, he/she shall designate one qualified member of his staff to perform the duties of Manager in his/her absence or disability. The person so designated shall not perform said duties for a period longer than two weeks without approval of the Board.
The office of Manager shall not be incompatible with the office of Township Secretary, Township Treasurer, or any other Township office or employment except those of Township Supervisor, Township Auditor, Township Assessor, Township police officer or Township Solicitor.
