A. 
No aircraft shall fly over the Town limits of the Town of Bethany Beach at an altitude of less than 1,000 feet above the highest obstacle.
B. 
No aircraft shall fly in proximity of the beach east of the Town limits of the Town of Bethany Beach at an altitude of less than 1,000 feet above the highest obstacle and within a horizontal radius of 2,000 feet of the easternmost part of the beach.
This article shall not apply to:
A. 
Aircraft performing the spraying of insecticides for mosquitoes under the State of Delaware mosquito control program.
B. 
Delaware National Guard and United States Coast Guard helicopters and airplanes.

Any person violating any of the provisions of this article shall, upon conviction, pay such fine as set out in Chapter 1, General Provisions, Article I, Penalties.
