The Town Manager or his or her designee is hereby authorized and empowered to exercise his or her informed judgment to determine and declare when conditions on the beach, boardwalk and/or in the ocean waters east of the Town limits create or potentially pose an unreasonable risk to the lives, personal health and/or safety of persons on the beach and/or the boardwalk and/or in the ocean waters.
No person shall be permitted on the beach and/or the boardwalk within the corporate limits of the Town of Bethany Beach when the Town Manager or his or her designee has declared that conditions exist so that such activities are dangerous to life and limb.
No person shall enter or swim in the ocean waters east of the corporate limits of the Town of Bethany Beach at any time that the Town Manager or his or her designee has declared that conditions exist so that such activities are dangerous to life and limb.

Any person convicted of violating any provision of this article shall be fined as set out in Chapter 1, General Provisions, Article I, Penalties.
