As used in this chapter, the following terms shall have the meanings indicated:
SKATEBOARDS, ROLLER SKATES AND IN-LINE SKATES
Pieces of wood, metal, fiberglass or other material to which wheels are attached.

A. 
It shall be unlawful to ride, operate or use any skateboard, roller skate or in-line skate in the Town of Bethany Beach in or on any of the following locations:
(1) 
The boardwalk, including the bandstand.
(2) 
All sidewalks, including ramps leading to and from the boardwalk.
(3) 
Garfield Parkway from Delaware Route 1 up to and including the boardwalk; provided, however, that nothing herein shall be deemed to prohibit the crossing of Garfield Parkway north to south, or south to north, at any street intersection by persons operating or using roller skates or in-line skates.
B. 
It shall be unlawful to ride, operate or use any skateboard in or on any of the following locations:
(1) 
All of Pennsylvania Avenue.
(2) 
Atlantic Avenue between Campbell Place on the north and Hollywood Street on the south.
C. 
However, anything in this chapter to the contrary notwithstanding, skateboards, roller skates and in-line skates may be permitted at specifically designated times and places within the Town by prior action of the Town Council.

Any person violating any of the provisions of this chapter shall be deemed guilty of a violation and, upon conviction thereof, shall pay such fines as set out in Chapter 1, General Provisions, Article I, Penalties. Each day any violation and any provision of this chapter shall continue or occur shall constitute a separate offense.
