A. 
The Town of Bethany Beach hereby adopts by reference the rules and regulations established by the Secretary of Transportation of the State of Delaware and the procedures for the issuance of permits for the movement of vehicles and/or load size and weight exceeding the maximum specified by Chapter 45, Title 21, Delaware Code.
B. 
Without a permit from the Town, it shall be unlawful for any person to operate a vehicle upon any street within the corporate limits of the Town of Bethany Beach in violation of those rules and regulations.
A. 
Any person wishing to drive or move or cause or knowingly permit to be driven or moved on any street or alley within the corporate limits of the Town of Bethany Beach any vehicle in excess of the load size or weight permitted by the rules and regulations referred to in Chapter 45, Title 21, Delaware Code, shall secure a permit therefor from the Town Manager and shall post a cash bond or other guaranty in such amount (not less than $1,000) in a form acceptable to the Town Solicitor, which deposit shall be returned in full to the applicant if the Town Manager determines that no damage has been done upon the conclusion of such vehicle's passage over Town streets or alleys.
B. 
The Town Manager, in considering the application for a permit, shall inspect, if possible, the carrying or hauling vehicle and also the load or object to be carried or hauled, and he shall consider the nature and condition of the streets to be traversed and the probability or possibility of damage thereto.
C. 
If satisfied that such streets will not be damaged by the moving or hauling of such weight or object, he shall grant a written permit which shall contain a description of the vehicle to be used and the weight or object to be carried or hauled, the route to be traversed and the time the permit shall cover and other conditions which he may consider necessary to protect such streets or alleys, and, thereupon, the designated streets or alleys may be used for the designated period for the hauling or carrying of the weight or object described in the permit. The Town Manager shall have power to withhold the permit until such conditions as he imposes for the preservation of the streets shall be complied with.

Any person convicted of violating this article shall pay such fines as set out in Chapter 1, General Provisions, Article I, Penalties, for each violation.
