It shall be unlawful for any child under the
age of 16 years to run through, wander or stroll through the streets,
roads, avenues or other public places of the Borough between the hours
of 11:00 p.m. and 5:00 a.m. prevailing time, unless accompanied by
a parent or duly authorized custodian having control of the minor.
The provisions of this chapter shall not apply
to any child 16 years of age or under who is gainfully employed or
a bona fide student of a school of evening instruction or who is in
attendance at a function sponsored by a religious or school organization
or in attendance at a properly supervised Borough program during the
time required to travel between the child's residence and place of
activity.
Should an emergency arise which necessitates
the presence of a minor child under the age of 16 years in any of
the places as hereinbefore provided after the curfew hour established
by this chapter, the minor shall have in his possession a note signed
by one of his parents, guardian or duly authorized custodian, stating
the nature of the errand, the necessity thereof, specifying the travel
area and time the note was issued.
Any police officer, truant or special officer
duly appointed by the Mayor and Council is authorized and empowered
to take into custody any minor child who may be in the act of violating
any of the provisions of this chapter. The officer shall report the
violation to the Chief of Police and notify the parent, guardian or
custodian of the minor child, as well as the penalty for a second
and subsequent violation, and shall release the child immediately
into the custody of the parent, guardian or custodian.
Any child 16 years of age or under who violates
the provisions of this chapter shall be dealt with as a juvenile offender.
In the event the individual involved has caused damage to private
or public property in the Borough, the parent(s) or guardians will
be responsible for payment for same.
