A. 
It shall be unlawful for any person to:
(1) 
Make any indecent exposure or exhibition of any kind in or upon any street, road, highway, place, alley or lane, public or private;
(2) 
Expose to public view his or her genitals, pubic hair, buttocks, perineum and region or pubic hair region;
(3) 
Exhibit, give, distribute, have in possession, sell or offer for sale any lewd or indecent book, picture or thing; or to exhibit or to perform any indecent, immoral or lewd play or other representation; or to behave in a lewd, indecent manner;
(4) 
Engage in any practice having a tendency to annoy persons passing on the streets or sidewalks, while sitting or standing on porches or lawns or yards facing the streets or sidewalks, by the making of indecent gestures or acts;
(5) 
Engage in any practice while passing on the streets or sidewalks, having a tendency to annoy persons sitting or standing on porches or lawns or yards facing the streets or sidewalks, by the making of indecent gestures or acts;
(6) 
Make any indecent exposure of his or her private parts or engage in any lewd or indecent act or behavior;
(7) 
Urinate or defecate in public places or streets or on the lawns or yards of private homes and residences or in the public view;
(8) 
From a street, highway or other public places, intentionally or willfully look into any window, door or other opening of any house or building with the intention of looking at or watching any person or persons partially or completely disrobed therein or engage in the practice of what is commonly known as a "peeping tom";
(9) 
Frighten or interfere with the occupant of any house or building;
(10) 
Loiter or assemble on the streets, at the corners of streets or in public places while being under the influence of intoxicating liquors or drugs;
(11) 
Obstruct or interfere with any person or persons lawfully being in and upon streets or public places or in public taxicabs, buses or conveyances;
(12) 
Possess a radio, phonograph, tape or cassette player, television, musical instrument, loudspeaker or amplifier, or other machine or device for the electronic or stereophonic production or reproduction of sound that is operated on any public street, highway, building, sidewalk, park, recreation area, thoroughfare or other public place and any vehicle on a public street, highway or public space that disturbs the public peace and quiet;
(13) 
Bring, consume or possess an open container of alcoholic beverage or wine in any public place other than those public places covered by an alcoholic beverage consumption license issued pursuant to Title 33 of the New Jersey statutes or where consumption of malt alcohol or wine is permitted by N.J.S.A. 2C:33-27.
(14) 
Set off or discharge any revolver, rifle, shotgun, pistol, gun, cannon, weapon or firearm of any description using cartridges or gunpowder for ammunition, provided that nothing contained herein shall be construed to extend to any police officer in the line of duty or by any official body as part of a community celebration or to any facility officially sanctioned and licensed for such activities by local, county, and state authorities:

(15) 
Possess, discharge, set off, fire or light any roman candle, carbide cannon, dynamite cap, rocket, firecracker or other fireworks;
(16) 
Revel, quarrel, fight, brawl or otherwise engage in any disorderly conduct so as to disturb the public peace and quiet;
(17) 
Beg food or monies;
(18) 
Sleep in any parked vehicle;
(19) 
Make, cause or suffer or permit to be made or caused upon any premises owned, occupied or controlled by him or her, or upon any public street, alley or thoroughfare, any unnecessary noises or sounds by means of the human voice or by an other means or methods which are physically annoying to persons, or which are so harsh or so prolonged or unnatural or unusual in their use, time and place as to occasion physical discomfort, or which are injurious to the lives, health, peace or comfort of other inhabitants;
(20) 
Be in possession of any picklock, key, crowbar, jack, bit or other implement with an intent to unlawfully break and enter into any building;
(21) 
Be in possession of any pistol, hanger, cutlass, bludgeon or other offensive or dangerous weapons with the intent to assault any person;
(22) 
Be in or near any dwelling house or building or in any place of public resort or assemblage for business, worship, amusement or other lawful purposes with an intent to steal any goods or chattels;
(23) 
Enter any building or go upon the lands belonging to the Board of Education of the Borough of Wharton or any building or lands used and occupied for school purposes by any private school and break, injure or deface such building or any part thereof or disturb the exercises of such school or molest or give annoyance to the children attending such school or any teacher therein;
(24) 
By noise or disorderly conduct in any public library or reading room, disturb or interrupt the quiet and good order of those who resort to and use said library or reading room for reading and study;
(25) 
Cast or throw any stick, stone or other substance at another person or at public or private property;
(26) 
Shoot from any air gun, machine gun, shotgun, pistol or rifle any shot or ball at, against or into any motor vehicle or other vehicle or building of any kind or of any lake or any other body of water;
(27) 
Place any stick, stone or other substance upon a public thoroughfare with the intent to damage any vehicle passing thereon or to injure the passengers therein;
(28) 
Place any stick, stone or other substance in any lake or other body of water with the intent to injure persons or property in the enjoyment and the use of said lake or other body of water;
(29) 
Knowingly give or cause to be given a false fire alarm in any manner or a false police call in any manner;
(30) 
Knowingly make a false or fictitious report to any member of a police department, rescue squad or fire department;
(31) 
Knowingly represent himself or herself in any telephone conversation to be another person or a fictitious person;
(32) 
Destroy, damage, deface or injure any public or private property;
(33) 
Destroy, injure or deface any of the wires, posts, machines, bells, sirens, boxes, locks or other apparatus of any police call system or fire alarm system;
(34) 
Knowingly destroy, deface, damage or remove any street sign or other public sign except in the course of a legal duty or responsibility;
(35) 
Obtain food, lodging or other accommodations or services from any hotel, inn, boardinghouse, bar, restaurant, eating house or culinary establishment or clubhouse without paying for same to the owner or keeper thereof;
(36) 
Travel on any bus or taxicab without having paid the fare and with the intent to avoid payment thereof;
(37) 
Invite or solicit, by word, act, sign or any device, unlawful sexual intercourse or any other unlawful, indecent or lewd act;
(38) 
Disrobe in any automobile, truck, bus or other means of conveyance upon any public street, highway, parking space or any other public place or in any quasi-public place;
(39) 
Possess any lottery slips, books or records pertaining to a lottery or gambling other than for legalized games of chance;
(40) 
Knowingly hinder, prevent or deter in any manner or by any device whatsoever any fireman or other person from rendering lawful assistance in abating or quelling a fire;
(41) 
Knowingly hinder or interfere with any fireman going to or returning from the place of a fire or from which an alarm proceeds;
(42) 
Hinder or obstruct the passage of any fire engine, hook and ladder truck or any other apparatus going to or from the place of a fire or from which a fire alarm proceeds;
(43) 
Obstruct any officer of the law in the performance of his or her duties;
(44) 
Willfully refuse or neglect to assist any officer of the law, when lawfully called upon to do so, in execution of any process or in the suppression of any breach of the peace or disorderly conduct or in the case of an escape or when such officer is resisted in the discharge of his duty, or any person who shall knowingly resist or oppose any officer or person authorized by law in serving or attempting to serve any writ, bill, order or process or when lawfully making an arrest;
(45) 
Knowingly, during any rescue squad call, hinder, prevent or deter in any manner or by any device whatsoever any squad member or other person from rendering lawful assistance in connection with the emergency call;
(46) 
Knowingly hinder or interfere with any squad member or other person going to or returning from the place wherefrom which an alarm proceeds;
(47) 
Hinder or obstruct the passage of any rescue vehicle or any other apparatus in going to or from the place from which an alarm proceeds; or
(48) 
Interfere with, hinder, disturb or obstruct the proceedings, functions or deliberations of the Borough Council of the Borough of Wharton, the Board of Education of the Borough of Wharton or any other official body of the Borough of Wharton.
Violation of any of the provisions of this chapter shall be punishable as provided in Chapter 1, General Provisions, Article I, General Penalty.
