Parks, playground and recreation areas of the Borough of Lewisburg are to be open between 8:00 a.m. and 11:00 p.m. for the general public and until 12:00 midnight for supervised activities.

The following acts, uses and conduct in the parks, playgrounds, recreation areas and municipal parking lots of the Borough are prohibited:
A. 
Possession or use of alcoholic beverages, except the use, possession and consumption of beer and/or wine may be permitted at the discretion of the Lewisburg Borough Council upon application submitted to the Borough of Lewisburg by a nonprofit corporation or organization at least 30 days in advance of an event scheduled for the purpose of fundraising and/or promoting such entity, subject to the following regulations:

(1) 
Upon submission of the application, a permit fee of $250 or such other fee as may be established from time to time by resolution of the Lewisburg Borough Council shall be paid, unless otherwise waived, to the Borough of Lewisburg.
(2) 
In considering an application and granting a permit for a scheduled event, the Lewisburg Borough Council may establish conditions and requirements in addition to those specifically set forth herein.
(3) 
Prior to the scheduled event, the applicant shall provide to the Borough of Lewisburg a special occasion permit issued by the Pennsylvania Liquor Control Board for the said event and proof of its purchase of liability insurance for bodily injury and property damage in the sum of at least $1,000,000 per single occurrence and $2,000,000 aggregate, with the Borough of Lewisburg being named as an additional insured.
(4) 
The application shall include the following:
(a) 
The name, address and telephone number of the applicant and the person representing the applicant;
(b) 
The requested public location for the scheduled event and its purpose;
(c) 
The requested area or square footage of public open space for the scheduled event;
(d) 
The maximum number of people who will attend the scheduled event;
(e) 
The time when the scheduled event will start and the time it will end;
(f) 
A description of the entertainment, if any, that will be present at the scheduled event;
(g) 
The manner in which the beer and/or wine will be served and consumed;
(h) 
The method by which the number of people attending the scheduled event will be regulated and/or controlled;
(i) 
Whether or not security will be provided and, if provided, the manner in which such security will be provided; and
(j) 
The applicant's intended use of any and all funds raised from the scheduled event and how the event is intended to promote the applicant.
(5) 
In addition to the applicant complying with any requirements or regulations imposed by the Pennsylvania Liquor Control Board, the applicant shall also comply with the following:
(a) 
No beer or wine shall be served to or consumed by any individual under the age of 21 years;
(b) 
The designated area of the scheduled event shall be cordoned off, and access thereto shall be restricted to only those individuals 21 years of age or older;
(c) 
Ingress to and egress from the scheduled event shall be monitored at all times, and no beer or wine shall be allowed outside the designated area of the event;
(d) 
One portable toilet shall be provided for every 100 individuals attending the scheduled event;
(e) 
Refuse and recycling pickup shall be provided for the scheduled event through the Borough of Lewisburg, which the applicant shall be responsible for arranging and paying all required fees therefor; and
(f) 
The applicant shall agree to indemnify, save harmless and defend the Borough of Lewisburg, and its officers, employees, agents and appointees, from any and all suits, actions and claims of any character, nature or description brought for or on account of any injuries, deaths or damages resulting to or sustained by any person, entity, or property at, during, after or as a result of the applicant's scheduled event, caused by an act, omission, negligence, or other misfeasance or nonfeasance of the applicant or any person, officer, agent, employee, corporation, partnership or other business entity hired or contracted by or associated with the applicant.
B. 
Boisterous, immoral or indecent conduct;
C. 
Discarding of trash, garbage or other litter, except into containers provided for that purpose;
D. 
Damaging, defacing, destroying or removing any Borough owned property, sign, structure, equipment or other material;
E. 
Distributing, selling, servicing or renting of any supplies, equipment, material or commodity whatsoever without written authorization from the Borough.
F. 
Operating, stopping or parking of any vehicle except on designated roads or areas;
G. 
Possession or discharge of any type of firearms, bows and arrows, air guns, slingshots or fireworks;
H. 
Ball playing, except on fields provided;
I. 
Letting pets run unleashed or on a leash longer than six feet or leaving pets unattended at any time.
J. 
Use or operation of any skateboards, except in designated areas; and

K.

Any person, firm or corporation who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $300, and/or to imprisonment for a term not to exceed 90 days.
