The name of this nonprofit organization shall be the "York County DUI System of Service Advisory Council."
The Council shall maintain a mailing address as shall be designated by the DUI Coordinator.
The purpose of the Council shall be to:
A. 
Act as a recommending body to both the DUI Coordinator and the Comprehensive DUI Model County Project Director regarding issues, problems and programs which arise under the DUI System.
B. 
Act as a body for public information and education with a goal to expose the general populous to a network of programs geared to combat the DUI dilemma.
A. 
Compilation. The Council shall consist of 15 to 30 citizens drawn from the private sector, law enforcement, local government, medical, health and education professionals and activist groups in York County. All Council members shall embody a keen interest in resolving society's conflict with the DUI offender.
B. 
Appointment. Each member of the Council shall be appointed by the DUI Coordinator and/or the Project Director of the Comprehensive DUI Model County Program and be introduced to the Council at the next stated meeting. The Council may recommend to the DUI Coordinator or Project Director of the Comprehensive DUI Model County Program for Council membership any individual it feels would provide positive input to Council business.
C. 
Withdrawal. Any member may terminate his/her membership at any time at his/her sole discretion by:
(1) 
Notifying the Council Secretary in writing.
(2) 
Failing to attend a minimum of two meetings per year.
(3) 
A two-thirds majority vote of the total Council membership.
D. 
Substitutes. Any Council member who cannot attend a stated meeting may send a representative in his/her place. That representative will have full voting privileges.
A. 
Titles.
(1) 
The York County DUI System of Service Advisory Council shall have as its designated officers the following:
(a) 
Chairman.
(b) 
Vice Chairman.
(c) 
Secretary.
(2) 
The DUI Coordinator shall be an ex officio, nonvoting member.
B. 
Qualifications.
(1) 
DUI Coordinator. The qualifications for this position shall be those as approved and sanctioned by the Alcohol Highway Safety Program (AHSP) and confirmed by the President Judge of York County.
(2) 
Chairman, Vice Chairman and Secretary. Any person who is designated as a member of the York County DUI System of Service Advisory Council and is in good standing may serve in any of these designated positions.
C. 
Term.
(1) 
DUI Coordinator: as approved by the Alcohol Highway Safety Program (AHSP) and confirmed by the President Judge of York County.
(2) 
The Chairman, Vice Chairman and Secretary shall remain in office for a period of one year beginning April 1 and continuing thereafter until April 1 of the subsequent year and shall have the ability to accept continued nominations for that position for a period of three consecutive years beginning April 1, 1985.
D. 
Election.
(1) 
In January, the Chairman shall appoint three members of Council to the Nominating Committee.
(2) 
At the February meeting, the Nominating Committee shall supply the names of individuals recommended by it to be the officers for the forthcoming year.
(3) 
Also at the February meeting, the Chairman shall open the floor for nominations from the Council at large for names of individuals to be officers for the forthcoming year.
(4) 
Voting will take place at the March meeting, which will be known as the "annual organizational meeting." The officers will be installed and assume their official duties in April of that year.
E. 
Duties.
(1) 
DUI Coordinator. This individual is responsible for program management and administration dealing with enforcement, public information, education adjudication and fiscal management.
(2) 
Chairman. This individual is responsible for the agenda of all meetings and shall preside over all meetings. This person shall be responsible for the appointment of all committee heads and shall avail himself as an ex officio member thereon and work with all committees.
(3) 
Vice Chairman. This individual shall assume those responsibilities of the Chairman in his absence, as well as any assigned duties.
(4) 
Secretary. This individual shall record and maintain minutes of all meetings, shall keep a list of all members, along with addresses and telephone numbers, and shall give official written notice of all regularly scheduled meetings, accompanied with minutes from the last meeting, as well as second all requisite notices for special meetings to Council members within five days of the special meetings.
A. 
Regular. The York County DUI System of Service Advisory Council shall meet no fewer than six times per year on dates, times and places the Chairman so designates.
B. 
Quorum. The presence of at least five members of the Council at the place and time of the designated meeting must be necessary and sufficient to constitute a quorum.
C. 
Voting.
(1) 
Each member on the Council shall have the right to cast one vote in all matters considered by the Council.
(2) 
On any issue requiring a two-thirds majority of the entire Council, ballots may be issued via the mail.
(3) 
Any member of Council who has a conflict of interest in any matter to be considered by Council shall inform all members present at the meeting of the material facts involved and his interest therein, be it financial or otherwise.
(4) 
Said member shall be restrained from voting on the topic unless a majority of the members present at that time approve and ratify that member's participation.
D. 
Annual. The March meeting of the York County DUI System of Service Advisory Council shall be designated as the annual meeting of the Council and shall be the designated time for the election of officers and the reorganization of said Council.
E. 
Special. Special meetings of the Council can be called by either the DUI Coordinator or any of the officers so long as all Council members are notified of the date, time and place, etc., by the Secretary at least five days prior thereto.
F. 
Notices. The minutes of each meeting and the exact date, time and place, etc., of all annual, regular and special meetings shall be forwarded by the Secretary of the Council to all members at least five days prior to the meeting.
G. 
Conduction of meetings. The Chairman shall conduct the meetings in any formal or informal manner he desires. However, should any dispute arise as to the procedures used, Robert's Rules of Order shall be the controlling factor.
H. 
Committees.
(1) 
Standing. The Nominating Committee shall consist of three members appointed from the Council at large by the Chairman yearly.
(2) 
Special. The Chairman shall have the ability to appoint special committee Chairmen who shall have the responsibility of organizing from the general membership of the York County DUI System of Service Advisory Council those individuals to work with them as they so desire.
These bylaws may be amended by a two-thirds vote of the entire membership body of the Council.
The York County DUI System of Service Advisory Council can be dissolved by a two-thirds vote of the entire membership body of the Council.
