GENERAL REFERENCES
Noise — See Ch. 144.
As used in this chapter, the following terms shall have the
meanings indicated:
The entire width between the boundary lines of every way
publicly maintained when any part thereof is opened to the use of
the public for purposes of vehicular traffic.
To ride in or on and to control the operation of a snowmobile.
Any person who operates or is in actual physical control
of a snowmobile.
Any person, other than a lien holder, having property in
or title to a snowmobile, and title to the use or possession thereof.
An individual, partnership, corporation or any body of persons,
whether incorporated or not.
Any motorized vehicle designed for travel primarily on snow
or ice, steered by wheels, skis or runners.
No person shall operate a snowmobile upon any highway, street,
alleyway or sidewalk within the city, with the following exceptions:
A.
Snowmobiles may be operated on a street, public highway or alleyway
within the City during a period of emergency, when so declared by
the Chief of Police, when travel by conventional automotive equipment
is not possible.
B.
Whenever it is impractical to gain immediate access to an area adjacent
to a public highway where a snowmobile is to be operated, the vehicle
may be operated adjacent and parallel to the highway for the purpose
of gaining access to the area of operation. This subsection shall
apply to the operation of a snowmobile from the point where the vehicle
is unloaded from a motorized conveyance to and from the area where
the snowmobile is to be operated when loading and unloading cannot
be effected in the immediate vicinity of the area of operation without
causing a hazard to vehicular traffic approaching from either direction
on the highway. Loading or unloading must be accomplished with due
regard to safety at the nearest possible point to the area of operation.
No person shall operate a snowmobile on or across private property
without the express permission of the owner of such property.
No person shall operate a snowmobile:
A.
At a rate of speed greater than is reasonable and proper and without
due regard for conditions then existing;
B.
While under the influence of alcoholic beverages or narcotic drugs,
or both;
C.
In a careless or negligent manner likely to endanger any person or
property, but without wantonness or recklessness;
D.
With willful or wanton disregard for the safety of persons or property;
E.
During the hours from 1/2 hour after sunset to 1/2 hour before sunrise
without displaying a lighted headlight and a lighted taillight; or
F.
Unless it is equipped with a muffler in good working order and in
constant operation to prevent excessive or unusual noise and annoying
smoke.
No owner shall permit his or her snowmobile to be operated in
a manner that violates any of the provisions of this chapter.
