The purpose of this schedule chapter is to inaugurate the government
of the City under this Charter, and it shall constitute a part of
this Charter only to the extent and for the time required to accomplish
this end.
A.
Date. This Charter shall be submitted to a vote of the registered
electors of the City of Rockwood at an election to be held on Monday,
June 10, 1985. The Charter shall be adopted if a majority of the ballots
cast thereon are in favor of adoption.
B.
Form of ballot. The form of the ballot for the submission of this
Charter shall be as follows:
Instructions: A cross (X) in the square [ ] before the word
"Yes" is in favor of the proposed Charter, and a cross (X) in the
square [ ] before the word "No" is against the proposed Charter.

C.
Notice of election. The Secretary of the Election Commission shall
cause to be published with the publication of this Charter, in the
manner provided by law, a notice of this election, the location of
the polling places, and that on the date fixed therefor the question
of adopting such proposed Charter will be voted on. He shall also
post such notice in at least 10 public places within the City not
less than 10 days prior to such election.
D.
Procedure governing election. In all respects not otherwise provided
for in Chapter 16 of this Charter, the election procedure shall be
in accordance with the provisions of the other chapters of this Charter.
A.
Election. The first election of officers provided for in this Charter
shall be held on the first Monday in April 1986. At this election,
the voters shall be entitled to vote for Mayor, not more than three
candidates for Council, and not more than one candidate for the Office
of Treasurer and of Clerk.
B.
Terms. Mayor, Clerk and Treasurer's term to be from the first
Monday following the election in 1986 until the first Monday following
the election in April of 1988.
C.
The office of Council shall be elected for terms beginning the first
Monday following the election in April 1986 until the first Monday
following the election in November 1990.
A.
The second election of City officers shall take place on the first
Monday in April 1988. At this election, the voters shall be entitled
to vote for a Mayor, not more than three candidates for Council and
not more than one candidate for the offices of Treasurer and Clerk.
B.
Terms. The terms of office for Mayor, Treasurer and Clerk shall begin
on the first Monday following the election in April 1988 and shall
end on the first Monday following the November election in 1990.
C.
The terms of office for Council shall begin on the first Monday following
the election in April 1988 and end on the first Monday following the
election in November 1992.
D.
After the April 1988 election, the provisions contained in this Charter
relative to elections and terms of officers shall govern.
For the purpose of initiating the procedure for the election
on the adoption of this Charter, the Charter shall take effect on
July 27, 1984. For all other purposes, this Charter shall take effect
on Monday, June 17, 1985, at 7:30 p.m. Eastern standard time.
A.
Nothing in this Charter, except as otherwise specifically provided,
shall affect or impair the rights or privileges of persons who are
City officers or employees at the time of its adoption.
B.
Except as specifically provided by this Charter, if, at the time
this Charter takes full effect, a City administrative officer or employee
holds any office or position which is or can be abolished by or under
this Charter, he shall continue in such office or position until the
taking effect of some specific provision under this Charter directing
that he vacate the office or position.
C.
An employee holding a City position at the time this Charter takes
full effect, who was serving in that same or a comparable position
at the time of its adoption, shall not be subject to competitive tests
as a condition of continuance in the same position.
A.
If a City department, office or agency is abolished by this Charter,
the powers and duties given it by law shall be transferred to the
City department, office or agency designated in this Charter or, if
the Charter makes no provisions, designated by the City Council.
B.
All property, records and equipment of any department, office or
agency existing when this Charter is adopted shall be transferred
to the department, office or agency assuming its powers and duties,
but, in the event that the powers or duties are to be discontinued
or divided between units, or in the event that any conflict arises
regarding a transfer, such property, records or equipment shall be
transferred to one or more departments, offices or agencies designated
by the Council in accordance with this Charter.
All rights, claims, actions, orders, contracts and legal or
administrative proceedings shall continue, except as modified pursuant
to the provisions of this Charter, and in each case shall be maintained,
carried on or dealt with by the City department, office or agency
appropriate under this Charter.
All City ordinances, resolutions, orders and regulations which
are in force when this Charter becomes fully effective are repealed
to the extent that they are inconsistent or interfere with the effective
operation of this Charter or of ordinances or resolutions adopted
pursuant thereto. To the extent the Constitution and laws of the State
of Michigan permit, all laws relating to or affecting the City or
its agencies, officers or employees which are in force when this Charter
becomes fully effective are superseded to the extent that they are
inconsistent or interfere with the effective operation of this Charter
or of ordinances or resolutions adopted pursuant thereto.
