Editor's Note: The purpose of this article was stated in the preamble to this ordinance, as follows:
Purposes. This ordinance is intended to protect the health, safety and general welfare of the residents of Dover Township who live within the area of contamination delineated by this ordinance, pursuant to specific powers of the Dover Township Board of Health under N.J.S.A. 26:3-31a, and specific directives of the New Jersey Department of Environmental Protection, Division of Water Resources.
It is the purpose of the ordinance to protect also the public water supply and to prevent potential contamination of various underground waters which may become polluted or contaminated due to continued use of wells within area delineated by this ordinance for any purpose.
It is a further purpose of this ordinance to comply with the specific directives of the New Jersey Department of Environmental Protection that the wells in the delineated area be closed and sealed as being contaminated.
The areas of contamination which this article is to affect and apply to are the properties located with frontage on the following streets in the Township of Toms River, County of Ocean:
A. 
Wallach Drive.
B. 
That portion of Dugan Lane west of the Garden State Parkway.
The use of private well water other than that provided for water mains within the contaminated area is hereby prohibited for any purpose as of the effective date of this article.
Upon the introduction of water mains and water service along the aforementioned streets, all private wells shall be closed and sealed in accordance with state regulations at the expense of the well owner and under the supervision of Toms River Township Board of Health.
The Toms River Township Board of Health adopts this article pursuant to the specific powers granted by N.J.S.A. 26:3-31a, said powers being exercised due to serious threat to the health, safety and welfare of the residents of the affected area in connection with contamination found in the well water of the area delineated.
There shall be no well installations of any type within the area delineated above in this article as of the effective date of this article.
The penalty for the violation of this article shall be not more than $500 nor less than $5. Each day that a violation of this article continues to exist shall constitute a separate and distinct offense.
