In their interpretation and application, the
provisions of this chapter shall be held to be the minimum requirements
for the promotion of the health, safety, morals and the general welfare
of the Village.
A. Wherever the regulations made herein require a greater
width or size of yards, courts or other open spaces or require a lower
height of building or lesser number of stories or require a greater
percentage of lot to be left unoccupied or impose restrictions more
extensive than are required in any other statute, ordinance or private
covenant or restriction, the provisions of the regulations of this
chapter shall govern.
B. Wherever the provisions of any other statute or ordinance
require a greater width or size of yards, courts or other open spaces
or require a lower height of building or lesser number of stories
or require a greater percentage of lot to be left unoccupied or impose
restrictions more extensive than are required by this chapter, the
provisions of such statute, ordinance or private covenant or restriction
shall govern.
C. It is not intended by this chapter to amend, repeal,
abrogate, annul or to impair or interfere with covenants, easements
or restrictions between persons or to rescind a building permit heretofore
issued by the Building Inspector of the Village. However, no provision
in any such covenant, deed restriction or contract shall be deemed
to justify noncompliance with any provision of this chapter.
If for any reason the location of any district
boundary line is not readily determinable from the Zoning Map, the location of such line shall be fixed by the Building
Inspector in accordance with the following provisions. Where more
than one of the following provisions are applicable, the first enumerated
applicable provision shall prevail:
A. Where a district boundary line is shown within a street
or road or the prolongation thereof, the district boundary line shall
be deemed to be the center line of such street or road or the prolongation
thereof, except that, where a district boundary line is shown as following
a boundary line of the Village, the district boundary line shall be
deemed to coincide with such Village boundary line.
B. Where a district boundary line is shown as approximately
following platted lot lines, the district boundary line shall be deemed
to coincide with such platted lines.
C. Where a district boundary line is shown as following
the line of mean sea level of Mill Neck Creek or the shoreline of
Beaver Lake, the district boundary line shall be deemed to coincide
with such line or shoreline, as the case may be.
D. Where a district boundary line divides a platted lot
or crosses a road or unsubdivided property, the location of the district
boundary line shall be fixed from the scale of the Zoning Map.

A. The provisions of this chapter shall be enforced by
the Building Inspector.
B. It shall be the duty of the Building Inspector to
record all applications for permits and certificates and to record
all permits and certificates issued, with a notation thereon of any
special conditions involved, and he shall file in the office of the
Village Clerk copies of such records, applications submitted, permits
and certificates issued and of all plans and plot plan surveys submitted.
