GENERAL REFERENCES
Fire prevention — See Ch. 139.
A. 
The City of Butler recognizes the need to provide, through its Bureau of Fire, certain expendable and/or disposable materials used in the abatement and/or control of certain fires and hazardous materials incidents, including but not limited to fire fighting foam and other hazardous materials abatement equipment (hereinafter collectively referred to as "materials").
B. 
Any person, group, agency, corporation or other entity whose actions or inactions result in an incident during which materials described herewith shall be responsible for the reasonable cost incurred or expended for the replacement of any material used or expended in the abatement or control of said incident.
C. 
Any agency, group, municipality, state or federal licensed fire department which requests that the City of Butler provide said materials shall be responsible for the replacement cost of any materials used or expended by said agreement.
A. 
The Mayor and Council of the City of Butler hereby authorizes the Fire Chief/Fire Marshal's office to recover the cost of said fire-fighting foam and other hazardous materials abatement material from any actor necessitating the dispensing thereof.
B. 
The Fire Chief/Fire Marshal's office shall have the authority to bill either an individual partnership cooperation (profit or nonprofit) or municipal subdivision.
C. 
The Fire Chief/Fire Marshal's office shall have the authority to bill a neighboring municipality for utilization of said fire-fighting foam and/or hazardous materials abatement material when dispensing thereof has been requested by said municipality, regardless of the cause of said dispensing.
The Mayor and Council may, from time to time, pass resolutions setting costs for fire-fighter's equipment and manpower for use in hazardous materials abatement activity.
