Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383),[1] the New Jersey Uniform Fire Code shall be locally enforced in the City of Linwood.

The local enforcing agency shall be the Linwood Bureau of Fire Prevention in the Linwood Volunteer Fire Company No. 1.
The local enforcing agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of the City of Linwood, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
The local enforcing agency established by § 152-1 of this chapter shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
The local enforcing agency established by § 152-1 of this chapter shall be a part of the Linwood Volunteer Fire Company No. 1. The local enforcing agency shall be under the direct supervision and control of the Fire Official, who shall report to the Fire Chief and/or the Councilperson in charge of the Fire Committee.

Appointment. The Fire Official shall be recommended by the Fire Chief upon approval of the City Council.

Term of office. The Fire Official shall serve for a term of two years. Any vacancy shall be filled for the unexpired term.

Appointment. Such inspectors and other employees as may be necessary in the local enforcing agency shall be recommended by the Fire Official and the Fire Chief upon the approval of the City Council.

Removal from office. Inspectors and other employees of the agency shall be subject to removal by the Fire Official and the Fire Chief of the Fire Company for inefficiency or misconduct. Each inspector or employee to be removed shall be afforded an opportunity to be heard by the appointing authority or a designated hearing officer.
The Fire Official shall investigate or cause to be investigated every reported fire or explosion occurring within the City of Linwood that involves the loss of life or serious injury or causes destruction or damage to property. Such investigation shall be initiated immediately upon the occurrence of such fire or explosion; and if it appears that such an occurrence is of a suspicious nature, the Fire Official shall take charge immediately of the physical evidence and, in order to preserve any physical evidence relating to the cause or origin of such fire or explosion, take means to prevent access by any person or persons to such building, structure or premises until such persons designated by law to pursue investigations into such matters become involved and shall further cooperate with such authorities in the collection of evidence and prosecution of the case.
The local enforcing agency established by § 152-1 of this chapter shall be a part of the Linwood Volunteer Fire Company and shall be under the direct supervision and control of the Fire Official and shall report to the Fire Chief.
Any member of the Fire Prevention Bureau or the Chief of the Fire Department may at all reasonable hours enter any building or premises within their jurisdiction for the purpose of making any inspection or investigation which, under the provisions of this chapter, he or they deem necessary to be made.
The Legal Department, upon request of the Bureau of Fire Prevention, shall assist the Fire Official in the investigation of any fire which, in their opinion, is of suspicious origin.
The Fire Official of the Linwood Bureau of Fire Prevention shall keep, in the office of the Bureau of Fire Prevention, a record of all fires and of all facts concerning the same, a record of all inspections and all orders issued.
An annual report shall be rendered by the Bureau of Fire Prevention as soon after the first of the year as possible and shall be transmitted to the Common Council. It shall contain all proceedings under this chapter, with such statistics as the Chief of the Fire Department may consider worthy of note. Said report may be combined with the report of the paid administrative Captain under the ordinance creating a Fire Department in the City of Linwood.[1] The Bureau of Fire Prevention shall also recommend any amendments to this chapter which, in its judgment, shall be desirable.
