GENERAL REFERENCES
Zoning — See Ch. 103.
As used in this chapter, the following terms shall have the
meanings indicated:
A business which operates either a bed-and-breakfast home,
bed-and-breakfast inn or country inn.
Owner-occupied and -managed residence resulting from a conversion
of a one-family dwelling, used for providing overnight accommodations
and a morning meal to not more than 10 transient lodgers, and containing
at least two, but not more than five bedrooms for such lodgers.
A professionally run business operated in a building which
is used primarily for providing overnight accommodations to the public
even though the owner may live on the premises. A bed-and-breakfast
inn can have accommodations for more than 10 guests and may have up
to 24 guest rooms. Breakfast is the only meal served and is included
in the charge for the room. A bed-and-breakfast inn may be saleable
to a new owner.
A professionally run business which offers accommodations
and dining. Overnight accommodations are available and a full-service
restaurant provides breakfast, dinner and perhaps lunch to overnight
guests and/or the public. The number of guest rooms may range from
four to 24. A country inn may be saleable to a new owner.
No person, either as owner, agent or otherwise, shall furnish,
operate, conduct, maintain, advertise or otherwise be engaged in the
bed-and-breakfast business unless the owner holds a valid permit issued
pursuant to this chapter.
A.
Certification. A permit shall be granted or renewed by the Building
Inspector upon certification by the Inspector, Niagara County Health
Department and Fire Marshal that all applicable codes and regulations
have been met. The Building Department may request any additional
information deemed necessary to determine whether or not a permit
shall be issued.
B.
Fee. Application for a permit or renewal shall be accompanied by
a fee of $30.
C.
Expiration. Permits shall be renewable every three years upon application
and inspection by the Building Inspector and Fire Marshal.
A.
A bed-and-breakfast home must be incidental to the use of the property
as a single-family home. The business operator must also occupy the
house as a primary residence.
B.
All bed-and-breakfast businesses must comply with the existing zoning
regulations.
C.
All facilities must conform with the New York State Uniform Fire
Prevention and Building Code, as well as all other applicable local,
state and federal regulations.
D.
Residential structures may be remodeled for the development of a
bed-and-breakfast business. However, structural alterations may not
be made which prevent the structure from being utilized as a residence
in the future, or which create a detriment to the surrounding residences.
Internal and external changes which will make the dwelling appear
less residential in nature or function are not permitted.
E.
Parking. One off-street parking space shall be provided in the driveway
or behind the business for each room designated as a rental quarter.
These spaces must be in addition to the off-street parking spaces
of the residents and must be maintained in a manner compatible with
the general character of the neighborhood.
F.
Cooking facilities are prohibited in individual guest rooms.
G.
Signage. Signage shall comply with the North Tonawanda City Code
and is subject to prior approval of the Building Inspector.
H.
Use by guests shall be temporary. No guest shall register for more
than four weeks in a three-month period.
This chapter shall take effect immediately.
