It shall be the duty of every person, firm or corporation, who shall have contracted or undertaken or shall be bound, to heat or to furnish heat for any building or portion thereof occupied as a dwelling of one or more persons or as a business establishment where one or more persons are employed, except in businesses or occupations where high or low temperatures are essential, so that a temperature of at least 68° F. is maintained between the hours of 6:00 a.m. and 10:00 p.m. whenever the outside temperature shall fall below 55° F. The temperature shall so read at a height of three feet above floor level at or near the center of the room.
Every building mentioned herein shall have heating facilities which are properly installed, maintained in good and safe working condition and are capable of safely and adequately heating any building or portion thereof.
Any person, firm or corporation who shall violate any provision of this chapter shall, upon conviction, be punished by a fine not to exceed $500 or by imprisonment in the county jail for a period not to exceed 90 days, or both, and each violation of any of the provisions of this chapter and each day that the same is violated shall be deemed and taken to be a separate and distinct offense.
This chapter and the standards established hereunder shall be enforced by the Health Officer or Sanitary Inspector of the First Grade or higher of the Township of Nutley.
