A.Â
No person shall fail to return any book, periodical,
pamphlet, artistic reproduction, audio/visual material or recording
or any other article, material or property or any part thereof, which
is borrowed from the Free Public Library of the Township of Nutley
by the due date established in the library's borrowing rules, regulations
and procedures. If library materials and property are not timely returned
by their due date, late fees and fines will accrue on a daily basis
thereafter at the rate established in the library's rules, regulations
and procedures.
B.Â
If library materials and property are not returned
within five months after the due date, the responsible person(s) will
become liable for the full replacement cost of those materials and
property together with accrued fees and fines and the costs and fees
associated with collection activities.
C.Â
A bill demanding payment for the materials and property
as well as for all accrued fees and fines will be sent after that
five-month period to the responsible person(s) by certified mail,
return receipt requested, addressed to the person(s) at the last address
furnished to the library. Personal service of such bill upon the responsible
person(s) or upon a person over the age of 14 years who resides in
the same household as the responsible person(s) may, at the library's
option, be used in place of mailing such bill as aforesaid.
D.Â
In the event the responsible person is a minor, then
the parent(s) or guardian(s) are also deemed to be responsible persons
responsible for the timely return of all library materials and property
and are jointly and severally liable for payment of all accrued fines,
fees and replacement costs of materials and property that were not
returned within the time periods set forth above.
No person shall cut, tear, deface, disfigure,
damage or destroy any book, periodical, pamphlet, artistic reproduction,
audiovisual material or recording or other article, material or property,
or any part thereof, which is borrowed from, owned by or is in the
custody of the library.
No person shall remove from the library any
materials or other property owned by or in the custody of the library,
unless such person shall have complied with the applicable rules,
regulations and procedures of the library governing the borrowing
of such materials or other property.

No person shall register or furnish a false name,
address or other required information to obtain a library card or
use without the owner's permission any library card other than one
issued to that person allowing for the borrowing of library materials
or other property from the library.
B.Â
No person shall allow another person(s), other than
family members residing in the same household, to use his or her library
card for the purpose of borrowing library materials or property from
the library.
Any person who violates or refuses to comply with the provisions of this Chapter 426 shall, upon conviction thereof, be required to pay the library bill and be subject to a fine not to exceed $200 or twice the amount of the bill, whichever is greater.
The Library Director or his or her designee is authorized to file a complaint in the Nutley Municipal Court or other appropriate court alleging a violation of this Chapter 426.
A copy of this Chapter 426 shall be posted in a conspicuous place in the library.
