A. 
The owner or tenant of any lands abutting upon the public highways of the Township of Nutley shall remove all snow and ice from the abutting sidewalks of such highways within 36 hours after the same shall fall or be formed thereon.
B. 
The owner of any garden apartment and the owner of any high-rise apartment or other multiple dwelling consisting of three or more apartments in the Township of Nutley shall remove all snow and ice from the sidewalks, roadways (dedicated and accepted public roadways of the Township excepted), parking areas, walks from the sidewalks to the entrances of the structures on the premises, walks and stairways to basements, storage areas and refuse storage areas of such garden apartments and high-rise apartment complexes and other multiple dwelling as herein defined within 36 hours after said snow and ice shall fall or be formed thereon.

No owner or tenant of any lands abutting upon the public highways of the Township of Nutley, nor any other person, shall remove the snow and ice from said abutting lands or any part of said lands and place or deposit the same in or upon said public highways.

If the owner or tenant aforesaid shall fail to remove said snow and ice within 36 hours, the Township of Nutley shall cause said snow and ice to be removed either by a private contractor or by the Public Works Department under the direction of the Municipal Engineer, and said Engineer shall certify the cost thereof to the Board of Commissioners, which shall examine the said certificate and, if found to be correct, shall cause the cost to be charged against the lands so abutting upon said sidewalk.
The amount so charged shall thereupon become a lien and tax upon said abutting lands and be added to and be part of the taxes next to be levied and assessed thereon, and shall be enforced and collected with interest by the same officers and in the same manner as other taxes.
The power and duty to enforce the provisions of this chapter are hereby assigned to the Department of Public Safety, and the same shall be exercised under the direction of the Police Department.

Any person or corporation violating any of the provisions of this chapter shall, upon conviction thereof, be punished by a fine of $500 or by imprisonment for a period not exceeding 90 days, or by both such fine and imprisonment. The imposition of one penalty for any violation of this chapter shall not excuse the violation or permit it to continue, and each additional 36 hours that the prohibited condition continues will constitute a separate offense.
