All wells operated by or located on land owned by the Township of Nutley shall be under the jurisdiction and control of the Department of Public Works. All such wells shall be referred to as "municipal wells" for the purposes of this chapter.
In the event that the Director of the Department of Public Works shall allow water to be drawn or taken from any municipal well by residents of the Township, he shall cause to be posted at the well in letters at least two inches in height the maximum number of gallons that may be taken by any person during any day. A day shall run from 12:01 a.m. to 12:00 midnight. Such maximum shall not exceed five gallons. No person shall take or cause to be taken from any such well more than the maximum number of gallons posted at such well during any day.
No person who shall be in possession or control of water drawn or taken from a municipal well owned or operated by the Township of Nutley shall sell or offer for sale such water or shall use same for commercial purposes. No person shall wash any animal or any vehicle at or near the well tap with water taken from such well.
The Director of the Department of Public Works is hereby authorized to prohibit the taking or limit the hours, days, amounts or manner in which water may be taken from any well owned or operated by the Township of Nutley. Such prohibition or limitation shall be posted at such well in letters at least two inches in height.
Any person who violates or fails to comply with the provisions of this chapter or of any notice posted pursuant to this chapter shall, upon conviction thereof, be liable to a penalty of not more than $500 or imprisonment for a term not exceeding 90 days, or both, for each offense.
