Table of Contents
The County Legislature, and all officers and employees thereof, shall comprise the legislative branch of the Monroe County government.
Public notice of all meetings of the Legislature and its committees shall be given by the Clerk of the Legislature in accordance with Article 7, § 99, of the Public Officers Law of the State of New York ("Open Meetings Law"). Public notice of the time and place of all meetings of the Legislature and its committees scheduled at least one (1) week prior thereto shall be given to the news media within the county and shall be conspicuously posted in one (1) or more designated public locations at least seventy-two (72) hours before such meeting. Public notice of the time and place of every other meeting of the Legislature and its committees shall be given, to the extent practicable, to the news media within the county and shall be conspicuously posted in one (1) or more designated public locations at a reasonable time prior thereto. In addition, the Clerk may otherwise publicize such meetings in such manner as he or she deems to be appropriate and practicable. Also, such notices shall be sent to persons or organizations requesting the same in writing. Agendas of legislative and legislative committee meetings shall be available in the office of the Clerk of the Legislature prior to the start of each meeting.
A. 
Pursuant to § C2-6C(9) of the Charter, specified appointments by the the County Executive shall be confirmed by a majority vote of the total membership of the County Legislature, in accordance with the procedures set forth in Subsection B of this section.

B. 
Confirmation procedures.
(1) 
The County Executive shall notify the County Legislature, in writing, of any appointment to any of the positions set forth in Subsection A above, at the meeting of the Legislature immediately following such appointment.
(2) 
Such notification shall contain pertinent information as to the background and qualifications of the person appointed to such position.
(3) 
The County Legislature shall schedule a meeting of the appropriate standing committee of the Legislature to interview such appointee. At least five (5) days' written notice of such meeting shall be provided to the County Executive and the appointee.
(4) 
Such-committee shall meet and review the qualifications of the appointee and, after review, shall report its recommendations to the County Legislature.
(5) 
The form of the County Legislature's resolution of confirmation shall be substantially as follows:
"The appointment of (name of person) to the position of (title of position) is hereby confirmed."
(6) 
The County Legislature may take one (1) of the three (3) following actions:
(a) 
Confirm.
(b) 
Not confirm.
(c) 
No action.
(7) 
A vote to confirm concludes the procedure. A vote not to confirm shall have the effect of terminating the appointee in such position as of the end of the next full payroll period. If no action is taken by the County Legislature within forty-five (45) days of the meeting of the Legislature at which the report of the standing committee was presented, such appointment shall be deemed confirmed.
(8) 
In the event of a vote not to confirm, the County Executive shall cause a search to be made for another candidate for appointment and, as soon as practicable, shall submit the name and qualifications of another appointee to such position in accordance with the procedures set forth above.

In the description of the districts set forth below, all references to towns apply to that territory wholly contained in each of the towns in the County bounded as of April 1, 2020. The boundaries of the 29 legislative districts shall be as follows:
(1) 
District 1.
(a) 
All of the Town of Parma.
(b) 
The following parts of the Town of Greece: Beginning at the point where the Town of Greece-Town of Parma boundary intersects the Lake Ontario shoreline, southeast following the contour of the Lake Ontario shoreline then southwest on the west bank of the Buck Pond inlet to Edgemere Drive, northwest on Edgemere Drive to the east bank of the Long Pond inlet, follow said bank to the eastern shoreline of Long Pond then southwest and south along said shoreline to Kuhn Road, west on Kuhn Road to Flynn Road, south on Flynn Road to Latta Road, west on Latta Road to North Greece Road, south on North Greece Road to West Ridge Road, west along West Ridge Road to the Town of Greece-Town of Parma boundary, north on said boundary to the point of the beginning.

The following parts of the Town of Sweden: Beginning at a point where the Monroe County-Orleans County boundary intersects the Town of Sweden-Town of Clarkson boundary, east along said boundary to the Town of Sweden-Town of Parma boundary, southwest on said boundary, continuing southwest on the Town of Sweden-Town of Ogden boundary to Campbell Road, west on Campbell Road to its intersection with Brockport-Spencerport Road, west on Brockport-Spencerport Road to its intersection with Lake Road, continuing west on Fourth Section Road to the Monroe County-Orleans County boundary, north along said boundary to the point of beginning.
(3) 
District 3.
(a)

A. 
Introduction of local laws. A proposed local law shall be introduced by a member of the County Legislature and then shall be referred to one (1) or more committees of the Legislature before being considered by the Legislature.
B. 
Passage of local laws. As set forth in § 20 of the Municipal Home Rule Law of the State of New York, no local law shall be passed until it shall have been in its final form and either upon the desks of the members of the Legislature at least seven (7) calendar days, exclusive of Sunday, prior to its passage or mailed to each of them in postpaid, properly addressed and securely closed envelopes or wrappers in a post box or post office of the United States Post Office Department within the county at least ten (10) calendar days, exclusive of Sunday, prior to its final passage, unless the County Executive shall have certified as to the necessity for its immediate passage and such local law is passed by the affirmative vote of two-thirds (2/3) of the total voting power of the Legislature.
C. 
Discretionary public hearing. The County Legislature, at its discretion, may set a public hearing before the Legislature upon any proposed local law. Public notice of the time and place of such hearing and a description of the proposed local law shall be given by the Clerk of the Legislature to the news media within the county and shall be conspicuously posted in one (1) or more designated public locations at least five (5) days before such hearing. If directed by the Legislature, the Clerk shall cause such notice to be published at least once in one (1) or more newspapers of general circulation within the county at least five (5) days before such hearing. In addition, the Clerk may otherwise publicize such hearing in such manner as he or she deems to be appropriate and practicable. Such notice shall also be sent to persons or organizations requesting the same in writing. Provided that the requirements of Subsection B above have been complied with, the Legislature may act upon a local law at any time subsequent to the holding of such discretionary public hearing.
D. 
Approval by County Executive. Upon passage of a local law by the County Legislature, such local law shall be presented to the County Executive for his or her approval as set forth in § 21 of the Municipal Home Rule Law of the State of New York.
The Deputy County Executive shall be a person qualified by formal training in public administration, finance or related fields or by equivalent experience and training sufficient to indicate capacity for effective governmental administration.
The County Executive shall hold no other public, political or private office or position and shall devote full working time to the county. The County Executive may serve in an ex officio capacity on various boards and commissions.

The County Executive and the heads of all departments and other agencies of the county shall be entitled to be present at all sessions of the County Legislature except when the Legislature by three-fourths (3/4) vote shall meet in executive session. The County Executive shall have the right to present his or her views on all matters coming before the County Legislature, and the heads of all departments and other agencies of the county shall be entitled to present their views on all matters coming before the Legislature relating to their areas of responsibility.

Any officer or employee of the county appointed by the County Executive or upon the Executive's authorization may be laid off, suspended or removed from office or employment by the County Executive or by the officer by whom appointed, subject to the Civil Service Law of the State of New York and other applicable law. Any head of a department or other agency who has been suspended or removed by the County Executive shall, within five days thereafter, be given a written statement setting forth the reasons therefor, if such department or agency head so requests, and shall have opportunity to answer in writing. After considering such answer, the County Executive shall make a final determination of the issue. A copy of the statement, a copy of the answer and a copy of the determination shall be filed as a public record in the office of the Clerk of the County Legislature.
In accordance with the provisions of § C2-6C(7) and § C3-2A(11) of the County Charter, the County Executive is delegated the power to create and abolish positions in the classification, compensation plan and salary schedule established by the County Legislature in group 15 and below and within budgetary appropriations therefor adopted by the County Legislature.

A. 
Except as set forth in Subsection B below and in accordance with the provisions of § C2-6C(13) and § C3-2A(17) of the County Charter and within budgetary appropriations adopted by the County Legislature, the County Executive is delegated the power to authorize, enter into and execute any agreement or contract on behalf of the county for goods and services where the total consideration thereof is $20,000 or less and any lease, rental, occupancy or other agreement for space needed for county activities for a term or terms not to exceed five years.

B. 
In accordance with provisions of § C2-6C(13) and § C2-4B(10) of the County Charter, the President of the Legislature is delegated the power to authorize, enter into and execute any agreement or contract on behalf of the county for the operation of the County Legislature, its staff and committees, and for goods and services where the total consideration thereof is $5,000 or less.
