The Mayor and Council of the Town of Clinton may declare by resolution
a drought emergency in the event of the following:
A.
The water level in the water storage facilities supplying
water to the Town of Clinton water system has fallen below safe levels;
B.
The use of pumped groundwater by the Town of Clinton
for its water supply system is approaching the maximum amounts authorized
by diversion permits issued by the State of New Jersey; or
C.
It is imperative to the public well-being that certain
uses of water, not essential to the health, welfare and safety of the public,
be restricted.
A.
In the event that a drought emergency is declared, the
uses and withdrawal of water from the Town of Clinton water supply system
by any person for the following purposes may be prohibited as follows:
(1)
Watering yards: the sprinkling, watering or irrigating
of shrubbery, trees, lawns, grass, ground covers, plants, vines, gardens,
vegetables, flowers or any other vegetation.
(2)
Washing mobile equipment: the washing of automobiles,
trucks, motorcycles, trailers, trailer houses, farm tractors or any other
type of mobile equipment.
(3)
Cleaning outdoor surfaces: the washing of sidewalks,
driveways, filling station aprons, porches, decks and other outdoor surfaces.
(4)
Cleaning buildings: the washing of the outside of dwellings,
businesses, offices or other buildings.
(5)
Ornamental fountains: the operation of any ornamental
fountains or other structures making a similar use of water.
(6)
Filling swimming pools: the filling of any pool, pond
or other facility for swimming purposes.
(7)
Escape through defective plumbing: the escape of water
through defective plumbing, which shall mean the knowing permission for defective
plumbing to remain out of repair.
B.
The Mayor and Council, by resolution, may prohibit all
or some of the foregoing activities and may limit the days or hours such activities
are permitted.
A.
The Public Works/Business Administrator of the Town of
Clinton, the Water Superintendent or their designee shall have the authority
to enforce the provisions of this chapter by the discontinuance of water service
in the event of violation hereof. If water service is discontinued for a violation
of this chapter, the fee to have the service resumed shall be $100.

B.
In addition, any person, firm or corporation violating
any of the provisions of this chapter shall be fined in an amount not exceeding
$1,000 for each violation hereof. Each day such violation is committed or
permitted to continue shall constitute a separate offense and shall be punishable
as such hereunder.
