The purpose of this chapter is to promote the health, safety and welfare of the residents of the Borough of Parkside.
No person, corporation, company, firm, partnership or other entity of any kind or nature shall sell, offer to sell, display or otherwise exhibit any goods, merchandise or services upon any sidewalk, driveway or lot within the Business Zoning District of the Borough of Parkside, except as provided in § 153-3 hereof. All goods, merchandise and services shall only be offered for sale or display within an enclosed building, except as provided in § 153-3 hereof.
A. 
Within the Business District of the Borough of Parkside, goods and services may be offered for sale, displayed for sale or otherwise exhibited upon sidewalks, lots and other open areas only at the following times and pursuant to the following regulations:
(1) 
On all federal holidays and for the seventy-two-hour period preceding the holiday.
(2) 
All such goods, merchandise and services offered for sale, displayed for sale or otherwise exhibited may only be so offered, displayed or exhibited upon the same lot of land described in the deed for the building in which the merchant of such goods, merchandise and services normally and generally conducts business.
(3) 
All such goods, merchandise and displays shall be removed from the open to an enclosed building at any and all times when the merchant is not open for business and from dusk until dawn.
(4) 
No such goods, merchandise or displays shall block or otherwise interfere with pedestrian or motor vehicle travel.
B. 
In addition to and not in limitation of Subsection A of this section, within the Business District of the Borough of Parkside, goods and services may be offered for sale, displayed for sale or otherwise exhibited upon lots and other open areas only at the following times and pursuant to the following regulations:
(1) 
In an area of any lot which does not exceed 5% of the square footage of the portion of the lot not covered by buildings, permanent equipment or other structures of any kind or nature.
(2) 
No item offered for sale, displayed for sale or otherwise exhibited shall be placed upon any sidewalk, driveway, roadway or portion of a parking area which is necessary to meet the minimum code requirements of parking places for the subject property.
(3) 
All such goods, merchandise and displays shall be removed from the open to an enclosed building at any and all times when the merchant is not open for business and from dusk until dawn.
(4) 
No such goods, merchandise or displays shall block or otherwise interfere with pedestrian or motor vehicle travel.
(5) 
All such goods, merchandise and services offered for sale, displayed for sale or otherwise exhibited may only be so offered, displayed or exhibited upon the same lot of land described in the deed for the building in which the merchant of such goods, merchandise and services normally and generally conducts business.
Any person, corporation, company, firm, partnership or other entity of any kind or nature found to be in violation of this chapter shall be subject to a fine not exceeding the sum of $1,000 on each and every day upon which the violation exists.
