This chapter shall be known as the "Games of Chance Ordinance of the
Town of Gates."
The purpose of this chapter is to authorize the conducting of games
of chance within the Town of Gates.
This chapter is enacted pursuant to the authority of Article 9-A of
the General Municipal Law of the State of New York.
The words and terms used in this chapter shall have the same meanings
as such words and terms are used in Article 9-A of the General Municipal Law,
unless otherwise provided herein or the context requires a different meaning.
"Town" means the Town of Gates; "officer" means the chief law enforcement
officer of the Town of Gates.
Games of chance may be conducted in the town by an authorized organization
after obtaining a license therefor in accordance with the provisions, requirements
and limitations of Article 9-A of the General Municipal Law, the rules and
regulations of the New York State Racing and Wagering Board and this chapter.
Pursuant to the authority contained in § 195 of the General
Municipal Law, the conduct of games of chance on Sunday is hereby authorized,
except for those days specifically prohibited in said § 195.
The adoption of this chapter is subject to a mandatory referendum. A
special town election shall be held in the Town of Gates for the purpose of
voting for the approval or defeat of this chapter. Such special election shall
be held on the date and at the times and places designated by the Town Board.[1]

This chapter shall take effect immediately after posting and publication
as provided in the Town Law and after a referendum, to be held as hereinbefore
provided, at which a majority of the qualified electors of the Town of Gates
voting at said referendum shall approve the same by voting for the proposition.
