[HISTORY: Adopted by the Board of Trustees of the Village of Horseheads 6-23-1977 as L.L. No. 9-1977. Amendments noted where applicable.]
It shall be unlawful for any person under sixteen (16) years of age to go, be, remain, loiter, idle, wander, stroll or play in or upon any of the streets, alleys, parks, playgrounds or other public ways or places in the Village of Horseheads between the hours of 10:00 p.m. and 6:00 a.m. unless such person is accompanied by a parent, guardian or other person having legal custody of such minor person or unless the employment or authorized school activity of such minor person makes it necessary to be upon such streets, alleys, parks, playgrounds or other public ways or places.
It shall be unlawful for any person having the legal care and custody of any person under sixteen (16) years of age to allow or permit any such minor person to go, be, remain, loiter, idle, wander, stroll or play in or upon any of the streets, alleys, parks, playgrounds or other public ways or places in the Village of Horseheads within the times specified herein unless the employment or authorized school activity of such minor person makes it necessary for such minor to be upon such streets, alleys, parks, playgrounds or other public ways or places.
The police force is hereby authorized to arrest, without warrant, any person who willfully violates the provisions of this chapter and to retain such person for a reasonable time in which a complaint can be made and a warrant issued and served.
Any person committing an offense against any provisions of this chapter shall be punishable as provided in Chapter 1, General Provisions, Article II, General Penalty. Each violation of the provisions of this chapter within a twenty-four-hour period shall constitute a separate offense.
