A clean, wholesome, attractive environment is
declared to be of importance to the health and safety of the inhabitants
and the safeguarding of their material rights against unwarrantable
invasion, and, in addition, such an environment is deemed essential
to the maintenance and continued development of the economy of the
Village of Delhi and the general welfare of its citizens. The unrestrained
accumulation of old, abandoned, unusable and inoperable automobiles,
rubbish, trash and other discarded material and the outdoor storage
of lawn mowers and similar machinery and equipment is a hazard to
such health, safety and welfare of the citizens of the Village of
Delhi, necessitating the regulation, restraint and elimination thereof.
As used in this article, unless the context
or subject matter otherwise requires, the following terms shall have
the meanings indicated:
A motor vehicle which is mechanically inoperable due to age,
deterioration or damage and has no economic value except for salvage
or junk.
Any item, thing or object which is no longer suitable for
the use it was originally manufactured or designed for and has no
practical economic value except for salvage or junk.
All cardboard, plastic, used metal or glass food containers,
wastepaper, rags, wood or lumber, plastic, rubber, leather or metal
objects that are broken or unusable for any practical economic purpose
and similar waste materials which may accumulate from any household,
farm or commercial or industrial operation.
A.
Wood intended to be used for fuel may be stored on
the property if neatly stacked at least one foot from any adjacent
property line.
B.
Where it is impracticable to neatly stack such wood
immediately, such wood may be stored unstacked and/or uncut for a
period not to exceed six weeks for cutting into firewood and neatly
stacking in accordance with this article.
C.
Under no circumstances, however, shall wood be stacked
or stored on the property which is closer than 15 feet to the curbline
or in such a manner as to block visibility.
A.
Written notice required. The Code Enforcement Officer
shall give written notice personally or by certified mail to the owner
or other person having control of any property in the Village on which
there is openly stored one or more abandoned motor vehicles, lawn
mowers and/or similar machinery or equipment, rubbish or trash in
such an amount as to cause an unsightly, unhealthy or hazardous condition
or discarded material in such a manner or amount as to cause unsightly,
unhealthy or hazardous conditions. Such notice shall provide that
the owner or person in possession or control shall remove the same
within 72 hours from the receipt of such notice. Failure to comply
with the notice within the time specified shall constitute a violation
as hereinafter provided.
B.
Exception. The placement of refuse or garbage for
collection shall not be deemed a violation of this article. However,
refuse or garbage for collection shall be in covered containers at
all times. Empty containers shall not be left at curbside for a period
longer than 24 hours.
