Be it hereby enacted by the Town Board of the Town of Cicero pursuant to the authority conferred by § 27 of the Executive Law of the State of New York, the following succession of authority is hereby established in the event that the Supervisor is absent from the town or is otherwise unable to discharge the powers and duties of his office provided under § 24 of the Executive Law, then that power shall devolve upon the next person available on the following list, until such time as the person acting under the authority conferred hereby is relieved by a person higher on this list:
A. 
Supervisor.
B. 
Deputy Supervisor.
C. 
Any Town Board member.
D. 
Chief of the fire company within the jurisdiction in which the emergency is occurring or has occurred.
E. 
Deputy Chiefs of the jurisdictional fire company.
F. 
Command Officers of the jurisdictional fire company.
G. 
Police Chief.
This chapter is not subject to mandatory or permissive referendum and is effective upon its filing with the Town Clerk, upon the filing of a certified copy in the office of the State Comptroller and upon the filing of three certified copies with the office of the Secretary of State.
