An advisory council, to be known as the “Bradford Woods Borough
Environmental and Parks Advisory Council” (hereinafter the "EPAC"),
is hereby established to advise other Borough agencies on matters dealing
with protection, conservation, management, promotion and use of natural resources,
including air, land and water resources, located within the territorial limits
of the Borough.
A.
The EPAC shall be composed of five residents of the Borough.
One member of EPAC shall also be a member of Borough Council and shall be
appointed by Council annually. The other four members of EPAC shall be appointed
by Borough Council for terms of three years each, which terms shall expire
on the first Monday in January following the last year of each member's term
of office; provided, however, that two of the initial appointments hereunder
shall serve until the first Monday of January 2000, and the other two shall
serve until the first Monday of January 2001.
B.
Members of the EPAC shall receive no compensation for
their services, but shall be reimbursed for the expenses actually and necessarily
incurred by them in the performance of their duties.
C.
Borough Council shall designate the Chairman of the EPAC
on an annual basis.
D.
Any vacancy which may occur in the membership of the
EPAC shall be filled by Borough Council.
A.
The EPAC shall have the following powers:
(1)
To identify environmental problems and recommend plans
and programs to the appropriate agencies for the promotion and conservation
of the natural resources and for the protection and improvement of the quality
of the environment within the territorial limits of the Borough;
(2)
To make recommendations as to the possible use of open
land areas of the Borough, including without limitation Borough park areas;
(3)
To promote a community environmental program;
(4)
To keep an index of all open areas, publicly or privately
owned, for the purpose of obtaining information on the proper use of such
areas;
(5)
To advise the appropriate local governmental agencies
in the acquisition of property, both real and personal, by gift, purchase,
grant, easement, devise or lease, in matters dealing with the purposes of
this chapter;
(6)
To maintain liaison with the State Conservation Commission
of the Department of Environmental Protection, the Secretary of Community
Affairs of the Department of State, and other municipal, state or federal
agencies, to utilize available assistance and information in furtherance of
the environmental purposes for which the EPAC has been created; and
(7)
To undertake such environmentally related tasks as requested
by Borough Council.
B.
The EPAC shall not exercise any powers or perform any
duties which by law are conferred or imposed upon an agency of the Commonwealth
of Pennsylvania.
The EPAC shall keep records of its meetings and activities and shall
make an annual report thereof to Borough Council.
Borough Council may appropriate funds for the expenses incurred by the
EPAC upon the prior request of the EPAC. Appropriations may be expended for
such administrative, clerical, printing and legal services as may from time
to time be required and shall be within the limits of funds appropriated to
the EPAC.
