As used in this chapter, the following terms shall have the meanings
indicated:
Shall be considered as that which is set up, maintained or continued
so as to interfere with or be injurious to the health of the community or
the public; or that which is an obstruction to the use of property.
Includes all streams and springs, and all bodies of groundwater,
whether natural or artificial, within the boundaries of the state.
A.
The purpose and intent of this chapter is to promote
and protect the health of the members of the community and the public.
A.
No cesspool, vault or outside privy or chemical toilet
for human excrement shall be constructed within the limits of the Borough
of Bradford Woods.
B.
The removed contents of septic tanks shall not be used
or disposed of on ground within the corporate limits of the Borough of Bradford
Woods.
C.
No kitchen, laundry or bath water shall be discharged
or be permitted to flow into any gutter, street or roadway, public place or
water of the state. Such wastewater may be disposed of by appropriate drains,
such drains to be entirely beneath the surface of the ground and to terminate
within the confines of the property.
D.
The use of land for the disposal of sewage is prohibited
except said disposal be conducted into a septic tank of adequate capacity
for the volume of sewage and wastewater carried into it; which septic tank
shall be constructed so as to purify sewage so emptied into it, and which
shall discharge it into adequate drainage system so as to secure distribution
and absorption of the overflow below the surface of the ground; provided,
however, that no such overflow shall be discharged within 10 feet of the property
line.
A.
No garbage, dead animals, decaying matter or waste of
any kind shall be thrown or deposited in any ravine, ditch or gutter on any
street, highway, or into any waters of the state, or be permitted to remain
upon the surface of the ground.
B.
The carcass of any dead animal shall be disposed of promptly
by burial. If death resulted from a communicable disease, the carcass, if
buried, must be enveloped in unslaked lime. Proper disposal shall be made
in every case by the owner, if known. If the owner is unknown, disposal shall
be made by the owner of the property on which the dead animal was found. If
the owner is unknown and the carcass was found on public property, disposal
shall be made by the Board of Health at public expense.
A.
No cows, horses, mules, goats or swine shall be stabled
or pastured within the Borough limits.
B.
The keeping of domestic animals other than those listed
shall be subject to the regulation of the Board of Health. These regulations,
after having been approved by Council and after being posted, shall have the
force of ordinance.
All bodies of water, whether natural or artificial, or containers or
receptacles containing water shall be maintained by their owners in such a
condition that mosquitoes cannot breed therein.
This section shall be covered under the provisions of 35 P.S. § 655.1
et. seq., regarding public eating and drinking places.
Any person, firm or corporation who shall violate any provision of this
chapter or who shall fail to post a bond shall, upon conviction before the
District Justice having jurisdiction thereof, be sentenced to pay a fine of
not more than $1,000, plus costs of prosecution, and, in default of payment
of such fine and costs, be subject to imprisonment of not more than 30 days.
