§ 21-1 Positions eligible for participation.

Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program:
A. 
Mayor and Council members.
B. 
Business Administrator.
C. 
Superintendent of Water Department.
D. 
Superintendent of Wastewater Treatment Plant.
E. 
Municipal Prosecutor.
F. 
Public Defender.

§ 21-2 Positions exempt from participation.

Individuals serving in the following positions are exempt from the Defined Contribution Retirement Program membership, pursuant to N.J.S.A. 43:15C-2:
A. 
Chief Financial Officer.
B. 
Construction Code Official.
C. 
Licensed Uniform Subcode Inspector.
D. 
Principal Public Works Manager.
E. 
Registered Municipal Clerk.
F. 
Tax Assessor.
G. 
Tax Collector.

§ 21-3 Implementation and construction.

This article shall be implemented, construed and subject to the aforesaid Chapter 92 of the Laws of 2007 (N.J.S.A. 43:15C-1 et seq.) as amended from time to time, and any regulations or guidance documents from the Local Finance Board for the Division of Pensions and Benefits.
