No person shall smoke or carry any lighted tobacco or cannabis products in any of the parks, playgrounds or park facilities, including Gebhardt Field and any other ballfields or recreational fields, within the Town of Clinton.

As used in this article, the following terms shall have the meanings indicated:
CANNABIS
All parts of the cannabis plant, whether growing or not; the seeds thereof, and every compound, manufacture, salt, derivative, mixture, or preparation of the plant or its seeds, resin, or oil. For purposes of this section, any reference to "cannabis" shall also include and incorporate by reference regulated cannabis, medical cannabis, unregulated marijuana and hashish.
SMOKING
The burning of, inhaling from, exhaling the smoke from, or the possession of a lighted marijuana cigarette, pipe, vape, or similar device, or other matter or substance which contains marijuana or any other matter that can be smoked, or the inhaling or exhaling of marijuana smoke or vapor from an electronic smoking device.
SMOKING DEVICE
Any electronic or other device that can be used to deliver cannabis, marijuana, or hashish or other related substances to the person inhaling from the devise, including, but not limited to, an electronic cigarette, cigar, cigarillo, pipe, or other devise used to consume these products. This definition includes "vaping" the above-described products.
TOBACCO
Any product made from the tobacco plant for the purpose of smoking, chewing, inhaling or other personal use, including cigars, chewing tobacco, pipe tobacco, snuff and cigarettes in any form.
The Public Works/Business Administrator or his designee is authorized to post adequate notice of the smoking prohibition in conspicuous places near the entrances to and within the parks, playgrounds, park facilities, ballfields and recreational fields.
Any person violating or failing to comply with any provision of this article shall, upon conviction thereof for a first offense, be punished by a fine of not more than $50, or by community service of not more than two days; for a second offense within the same calendar year, by a fine of not more than $100, or by community service of not more than five days; for a third offense within the same calendar year, by a fine of not less than $200, or by community service of not less than 10 days, or any combination of fine, imprisonment or community service as determined in the discretion of the court.

A. 
The following hours of operation shall apply to Town parks and open space:
(1) 
Hunts Mill: 6:00 a.m. to 10:00 p.m.
(2) 
DeMott Pond: 6:00 a.m. to 10:00 p.m.
(3) 
Community Center and facilities: 6:00 a.m. to 10:00 p.m. or the conclusion of sanctioned activities inside the Community Center.
B. 
Notwithstanding the hours of operation noted above, all basketball courts, tennis courts and baseball fields shall be open to the public for play beginning at 7:00 a.m.
The Public Works/Business Administrator or his designee shall post notice of the hours of operation of the parks and recreation facilities near the entrances to such facilities.
The penalties for violation of this article shall be as allowed by law.
