A. 
Burning of garbage and trash prohibited. No person shall burn garbage, paper, putrid materials, buildings or other structures, lumber, construction materials, or materials from razed buildings.
B. 
Outdoor burning is regulated except as prohibited by Subsection A. Outdoor burning within the Village shall be allowed as follows:
(1) 
The burning of dry brush, dry leaves, dry limbs, dry plant clippings, dry branches and dry logs is allowed subject to the following regulations:
(a) 
There will be no burning of yard waste in piles exceeding five feet in diameter and three feet in height.
(b) 
The burning of either wet or dried grass is prohibited. Composting is encouraged.
(c) 
Prior to controlled burns of prairie grasses, notification must be given to the Waukesha County Sheriff's Department. Notification must also be made when the burn is complete. A competent person of legal age must constantly supervise such burning.
(d) 
All outdoor burning must be attended at all times with sufficient fire-fighting equipment such as rakes, shovels, hoses connected to a water supply, fire extinguisher and similar materials to allow the property owner to control the fire.
(e) 
Burning barrels, constructed and elevated in substantial conformance with the design provided by the Village of Wales, are acceptable for burning only the items in Subsection B(1). A copy of the design is available at the Village Hall.
(f) 
Burning shall be permitted during these periods:

[a] 
Days: every day.
[b] 
Hours: 8:00 a.m. to sunset.
[2] 
March 16 to November 14:
[a] 
Days: Tuesday, Thursday, and Saturday.
[b] 
Hours: 8:00 a.m. to sunset.
[3] 
National holidays: no burning.
(g) 
All fires most be extinguished by the cutoff time. A smoldering fire will not be considered extinguished.
(h) 
No burning shall be permitted when the wind exceeds 15 miles per hour.
(i) 
If the smoke created by such burning affects visibility on highways or streets, law enforcement officers may order the fire to be extinguished.
(j) 
No burning is allowed on Wisconsin Department of Natural Resources designated ozone action days.
(k) 
No burning shall be done in Village rights-of-way. Burning shall be at least 20 feet from any Village residence and 10 feet from any lot line.
(2) 
Exceptions:
(a) 
Cooking fires in barbecue pits, grills and outdoor fireplaces.
(b) 
Campfires consisting of burning logs, twigs or sticks in a fire ring. Campfires must be extinguished by 12:00 a.m. (midnight).

All burning on any commercial, business or other property within the Village, except for residential, is hereby prohibited.
Any person, business, corporation or organization who or which violates the terms of this chapter or burns in a manner which results in a fire run from any fire department shall, in addition to the penalties provided herein, be liable to the Village for the current charge for a fire run by the Wales/Genesee Fire Department.
Penalties are pursuant to § 1-4 of the Code of the Village of Wales.
