No person shall maintain or construct any fence composed in
whole or part of barbed wire or with any similar materials designed
to injure any person or any wire charged with electrical current,
except to protect industrial and agricultural property, in which case
the barbed wire shall not exceed six feet in height and shall extend
inward from the property line. No person shall maintain any fence
containing barbed wire along or near any public sidewalk.

A.
Residential properties.
(1)
No building permit shall be required for the construction
of fences on any property located in a residential zoning classification,
provided that the fences meet the following conditions:
(a)
The fence is constructed in the rear and side
setback areas of the property;
(b)
The fence does not exceed four feet in height;
and
(c)
The fence is of open chain link construction,
rail-type fence material, or slatted boards, which are installed and
constructed in a manner so as to eliminate the accumulation of debris
at the bottom of the fence.

Any fence which does not meet the conditions set forth
herein shall require Plan Commission approval and shall require issuance
of a building permit prior to the commencement of construction.
B.
Maintenance. Fences shall be constructed and maintained
in good, sound, and presentable condition at all times. Fences which
are not maintained as required herein and as a result have an adverse
affect on the property values of the neighboring properties or upon
the use and enjoyment of the neighboring properties shall be removed.
Notice requiring the property owner to remove such fences shall be
issued by the Building Inspector and shall require removal within
a reasonable period of time, but not to exceed 30 days. Any property
owner receiving a notice requiring removal of a fence may appeal such
an order to the Village Board, in writing, within 10 days of the receipt
of the notice requiring removal of a fence. The determination of the
Village Board with respect to the appeal shall be final and binding
upon all parties.
Except as otherwise provided, any person found to be in violation of any provision of this chapter shall be subject to a penalty as provided in § 1-4 of this Code.
