[Adopted 12-21-1988 as Ch. 31, Art. I, of the 1988 Code]
There is hereby continued in the Village of Harriman a Village of Harriman Police Department as previously established by resolution dated August 20, 1981.
Hereafter and until further determination by the Board, the personnel of such Police Department shall consist of a Chief and such other officers as the Board may approve from time to time.
Subject to the approval of the Board, the Mayor shall appoint such Chief and additional personnel which, in his discretion, he shall feel qualified to hold such position. Any appointment shall be made in the manner prescribed by law, particularly the Civil Service Law of the State of New York, and all such appointees shall have such training as may be required by law, particularly § 2.30 of the Criminal Procedure Law, and shall possess the necessary certificate of retraining required by said law.
Said police officers and Chief of Police shall have all the powers and duties conferred upon them by § 8-802 of the Village Law and § 2.20 of the Criminal Procedure Law.
Except for uniforms, weapons, ammunition and other gun-belt equipment and within budgetary appropriations, the Mayor and/or the Chief of Police be and hereby are authorized to purchase in the name of the village such equipment and material as may be needed to equip such a Police Department.
The duly appointed Chief of Police shall be the chief administrative officer of such Police Department, responsible for the performance and operation thereof, and shall promulgate such rules, regulations and orders as he shall deem necessary for the operation of such Police Department. He shall report, in writing, the Departments activities to the Village Board of Trustees at least monthly.
[The Rules and Regulations, Rules of Conduct and Operating Procedures of the Village of Harriman Police Department, as adopted 9-1-1982 and as amended, are the controlling guidelines for the maintenance and operation of the Village Police Department. Such rules are on file in the Village Clerk's office.]
