[HISTORY: Adopted by the Board of Trustees of the Village of Harriman 12-21-1988 as Ch. 70 of the 1988 Code. Amendments noted where applicable.]
GENERAL REFERENCES
Construction and demolition material disposal — See Ch. 63.
It has come to the attention of the Village Board of Trustees that individuals, persons and organizations have been dumping garbage and refuse onto the streets of Harriman and onto various properties located within the Village of Harriman. These materials are not only unsightly and create a nuisance to the public at large but also represent a potential health hazard. Therefore, the Village Board of Trustees wishes to implement this chapter to prohibit improper and illegal dumping in the Village of Harriman.
For the purposes of this chapter, the following terms shall have the meanings indicated:
GARBAGE
Waste food, papers, dead animals or parts thereof, wood, lumber or vegetable matter of any kind or any other matter which shall be flammable or capable of fermentation or decay.
PERSON
An individual, society, club, firm, partnership, corporation or association of persons; and the singular number shall include the plural number.
RUBBISH
Waste metal, tin cans, ashes, cinders, glass, pottery and other similar substances of a solid and incombustible nature.
No person shall throw or deposit or cause to be thrown or deposited any garbage or rubbish or abandoned vehicles or parts thereof in any public or private place in the village.

Provisions of § 70-3 hereof shall not apply to rubbish stored or kept outside on the days of the year designated by the Village of Harriman for the pickup of rubbish, commonly called "cleanup days."
The Code Enforcement Officer of the Village of Harriman and the Village Police Department are hereby authorized to issue appearance tickets for violations of this chapter.
Any person who violates any provision of this chapter shall be guilty of an offense and shall, upon conviction thereof, be subject to a fine of up to $250 per day from the date of notification from the Code Enforcement Officer or the village police, either by letter, personally or by the issuance of an appearance ticket, and/or a term of imprisonment for a term not to exceed 15 days.
