A.
No person shall use, discharge or carry loaded within
the boundaries of the Village of Harriman, New York, any gun loaded with shell
or cartridge or any air gun, spring gun, BB gun, pellet gun or any gun commonly
known as a paintball gun from which a shot, pellet or paintball may be discharged
by a spring or by air or gas. The provisions of this subsection shall not
apply to peace officers engaged in law enforcement duties.[1]
B.
No pyrotechnics or fireworks shall be discharged within
the Village of Harriman without permission from the Board of Trustees.
As used in this chapter, the following terms shall have the meanings
indicated:
Any squib, rocket, firecracker, roman candle, fire balloon, signal
lights, railroad track torpedo, flashlight composition, fireworks or other
devices or composition used to obtain a visible or audible pyrotechnic display.
In the event that permission is given, such permit shall indicate the
exact time when, the place where and the detailed method by which the act
permitted is to be executed, and suitable indemnity shall be given to the
village against all claim against the village arising from the act so permitted.
Any person violating this chapter shall be liable to a penalty not exceeding
$250 for each offense and/or 15 days in jail.
