By virtue of this chapter, the position of Township
Administrator be and is hereby created by the Township of Elk pursuant
to the law.
A.
The Administrator shall be appointed by majority vote
of the Township Committee.
B.
The term of service of the Administrator shall be
at the pleasure of the Township Committee. The Administrator may be
removed by a two-thirds vote of the entire Committee. The resolution
of removal shall become effective three months after its adoption
by the governing body. The governing body may provide that the resolution
shall have immediate effect; provided, however, that the governing
body shall cause to be paid to the Administrator forthwith any unpaid
balance of his or her salary and his or her salary for the next three
calendar months following adoption of the resolution.

C.
During the absence or disability of the Administrator,
or upon the removal or resignation of the Administrator, the Committee
may, by resolution, appoint an Acting Administrator to perform the
duties of the office. Removal of the Acting Administrator shall be
by a simple majority vote of the Township Committee.
D.
The Administrator and Acting Administrator shall not
be prohibited from holding other positions within the Township.
The salary and benefit package of the Administrator
shall be set and adopted by the Township Committee and the Elk Township
Salary Ordinance.
The Administrator shall possess qualifications
deemed necessary by the Township Committee for the effective and efficient
management of the daily operations of the Township of Elk. Specifically,
the Administrator, as a minimum, shall hold a bachelor's degree.
The Administrator shall be the Chief Administrative
Officer of the Township of Elk, responsible to the Township Committee
for the administration of all Township affairs and with the following
duties and charges;
A.
Direct and supervise the administration of all departments,
offices and agencies of the Township, except as prohibited by law.
B.
Attend all meetings of the Township Committee, except
as prescribed by the majority of the Township Committee, with the
right to take part in the discussion but not to vote.
C.
Work with the Chief Financial Officer to prepare and
submit the annual budget and capital program to the Township Committee.
D.
See that all laws and acts of the Township Committee
subject to enforcement by the Administrator and employees subject
to direction and supervision by the Administrator are faithfully executed.
E.
Submit to the Township Committee and make available
to the public a complete report on the administrative and financial
activities of the Township as of the end of the fiscal year.
F.
Make such other reports as the Township Committee
may require.
G.
Keep the Township Committee fully advised as to the
current financial condition and future needs of the Township, and
make such recommendations to the Township Committee concerning these
affairs.
H.
Along with the appropriate Township Committee person(s),
negotiate all contracts with any collective bargaining units acting
in the Township.
I.
Appoint and, when necessary, remove the Township employees,
upon the proper consultation with the Township Committee.
J.
Produce and maintain the proper written rules and
procedures of the Township, so as to protect the residents, employees
and Township Committee of the Township of Elk.
K.
Perform such other duties as may be required by the
Township Committee.
