In order to advertise the advantages of Elk Township (hereinafter referred
to as the "Township") to businesses that fit the framework of the Township.
The Economic Development Committee (herein referred to as the "Committee")
will analyze the economic potential and development of the Township, and will
mobilize and assist in the development of potential resources and economic
conditions of the Township. The Committee will also work with current businesses
located within the Township to assist them with their concerns and support
existing business improvement and economic conditions. With these goals in
mind, there is hereby created and established by this chapter a committee
to be known as the "Economic Development Committee of the Township of Elk."
A.Â
The members of the Committee shall be appointed by the
Mayor with the advice and consent of the Township Committee. Each member shall
be, for the last five years preceding his appointment, a citizen of the United
States and a qualified voter of the State of New Jersey. One member shall
be appointed for one year; two members for two years; two members for three
years; and two members for four years. At the expiration of each of the above
terms, the new member or members shall be appointed for a term of three years.
Vacancies in the membership of the Committee, occurring for whatever cause
prior to the expiration of the member's term, shall be promptly filled
by appointment for the unexpired term thereof. The appointments shall take
place in the same manner in which the original appointments are made. Members
shall serve for their respective terms and until their successors are appointed
and qualified.

The Mayor and/or Township Committee designee and Township
Zoning Officer and/or designee shall automatically be nonvoting members of
the Committee in addition to seven voting members. The Township Planner shall
assist the committee as a nonvoting member as deemed necessary by the Township
Committee.

Each voting member shall be chosen with a view to his/her
qualifications and fitness for service, shall have had experience in industry
and commerce, shall be conversant with the economic needs and facilities in
Elk Township and shall be of known devotion to public service. Each voting
member should also be either a resident or an employee of the Township.
D.Â
All terms set forth in Subsection A herein shall expire on December 31. A member appointed for one year shall expire December 31, 2007; the two-year terms shall expire December 31, 2008; the three-year terms shall expire December 31, 2009; and the four-year terms shall expire December 31, 2010. At the expiration of each of the above terms, the new member or members shall be appointed for a term of three years beginning January 1 of the given year.
Members of the Committee shall annually choose from among its voting
members a Chairman, a Vice Chairman and a Secretary. A majority of the voting
members shall constitute a quorum.
The members and officers of the Committee shall serve without compensation
except for legitimate costs approved by the Township Committee upon proper
submission and review for Committee expenditures.
Each member and officer of the Committee shall, before assuming office,
take and subscribe an oath that he/she will faithfully and impartially discharge
the duties of his/her office.
The Economic Development Committee shall be strictly an advisory committee.
It shall perform the functions and exercise the powers hereinafter enumerated:

It will develop ways and means of attracting industry
and commerce into the Township within budgetary limitations.
B.Â
It will make recommendations to attract industry and
commerce and forward the same to the Mayor and Township Committee for consideration.
C.Â
It will act as a liaison for new businesses between the
Planning/Zoning Board, the Environmental Commission and the Municipal Utilities
Authority.
D.Â
It will assist in coordinating programs and projects
aimed at the retention of existing businesses as well as the attraction of
new or expanded business opportunities within the Township.
E.Â
It will submit written reports to the Mayor and Township
Committee outlining its recommendations and advice on business development
within the Township.
The Committee shall not have any powers other than those set forth,
and specifically shall have no power to pledge the credit of the municipality
or to enter into contracts or to create debts except as authorized. It shall
operate within the appropriation made by the Township Committee in its annual
budget. The Committee shall make an annual report to the municipality during
December of each year, setting forth, in detail, its operations and recommendations
covering the preceding 12 months.
