A. 
No person, firm or corporation without first having obtained a license therefor shall peddle goods, wares or merchandise in any public street, avenue, sidewalk, lane, alley or in any public place in the Village of Athens or sell or offer for sale any goods, wares or merchandise in, upon or from any booth or stand in any public street, avenue, lane, alley or sidewalk or in any public place in said Village; provided, however, that this section shall not apply to wholesale salesmen selling goods, wares or merchandise exclusively to dealers or merchants, nor to the peddling of meats, fish, fruit or farm products, nor to sales by public officers by order of any court of competent jurisdiction, nor to the sale of meats, fish, fruit and farm products in any public market now or hereafter authorized or established by the Board of Trustees of this Village. Additionally, there shall be no use of any municipal water or electric service by any person without prior written approval from the Village Board in the context of such a license.
B. 
A license may be obtained by the filing of an application therefor in a form prescribed by the Village Board and filed with the Village Clerk. The Village Clerk shall refer the application for determination by the Village Board. The Board may impose restrictions and/or conditions of approval that are reasonably related to the best interest or safety of the residents of the Village or the general public.
Any person, firm or corporation applying for the license required by § 188-1 shall, at the time of making application therefor, pay a fee in the amount set from time to time by the Board of Trustees.

Notwithstanding the foregoing, for as long as there exists a Street Festival Committee under the auspices of the Village Board of Trustees which sponsors an Athens Street Festival annually in July, the provisions of this chapter shall not apply to activities undertaken in connection with or during such festival and any other similar event sponsored by the Village, and any permits or fees required of vendors shall be those established and required by said Committee with the approval of the Board of Trustees.

Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be punishable as provided in Article I, General Penalty, of Chapter 1, General Provisions, of the Code of the Village of Athens.
